I am also seeking any communications, memos, and other documents relating to healthcare workers strikes in this same time frame, such as the many that took place in Massachusetts, Vermont, Rhode Island, etc. in the past few years.
I request that I be properly classified as a news media requester. I am an intern for MuckRock, and I am requesting this information in that editorial capacity. MuckRock is widely known for its investigative work as well as historical pieces based on public records requests.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I'm going to need some more information about and some clarification of your request before I understand what you are looking to receive. I'm not sure how familiar you are with our Agency and what we do, but we generally have two kinds of cases: unfair labor practice cases, where a union or employer is alleged to have violated the National Labor Relations Act in some way, and representation cases, where elections are held to determine whether a particular group of employees will be represented by a labor organization. What kinds of cases involving those groups are you looking to get? Any of them could have had charges filed against them, any of them could have filed charges against an employer, and any of them could have been involved in a representation case. If you're just looking for an idea of what happened in the case, narrowing your request to the formal records in a specific kind of case could be a good way to see what the case was about and whether you'd like to file a follow-up request for more information on any of them. If you can help me understand what you're trying to find, I can maybe help point you in the right direction.

You can then narrow to specific kinds of cases (unfair labor practice or representation), as well as by date, and by region. As to the second part of your request, I will need a case name or a case number in order to search for those records. I don't have a way to search for "healthcare workers strikes" in our system and we would only have records related to those strikes if charges were filed with us.

At your earliest convenience, could you please advise as to whether you are still in need of the requested records or if the proactively posted information satisfied your request? As you can imagine, there are a number of cases responsive to the first portion of your request - both representation and ULP cases - and the responsive records are likely to be in the thousands of pages. In an effort to get you what you need, some clarifying information would be useful before a considerable amount of time is spent responding to your request.
Additionally, if you are still in need of these records, I will need for you to provide a case name and/or a case number for the portion of your request that seeks records related to "healthcare workers strikes" as I have no way to retrieve records based solely on those key words.

Hi Theresa,
I'm sorry I'm only just now getting back to you! Yes, I can clarify my request and I am still seeking these files. I apologize for the vague request parameters.
What I am primarily seeking is any complaints issued by hospital industry employers to the NLRB regarding nurses strikes and/or organizing efforts from 2015-2019 against the nurses unions listed in my original request. I know that Labor-Management Relations files are kept in files under serial number 408-03, so I would like any responsive files therein. I would also like a copy of any responsive files under Labor Organization Recognition (408-01) and Unfair Labor Practice Complaints (408-02).
Also, if you have a reference document showing how NLRB codes different kinds of cases, I'd like that as well -- it might be helpful in further narrowing my request so it's easier for you to respond to.

Thank you for speaking with me today. As discussed I have forwarded the Election reports from fy2015 to the present which indicates all petitions/elections during that time period. In the report you will see the parties and the outcome of the actual election. These are all of the elections and you would be able to pinpoint the nurse unions that were part of the elections. You indicated that after sifting through the reports you may in the future make another FOIA request for individual petitions.
As discussed, with these documents on hand you will be closing the request.
