This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of any letters, emails, or other communications sent or received by the NSA to any representatives of Utah government agencies or policy makers regarding utility rates and taxes in connection with the NSA's Utah Data Center and/or Utah HB325.

The existence of such communications was previously reported on here:

At least some responsive documents will include emails from Harvey Davis, NSA director of installations and logistics.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

In accordance with your 3 July 2013 letter (enclosed), please find enclosed a check for $264.00 as payment for processing regarding request 70759A.

This payment does not waive my rights to further appeal or litigate fee assessments, particularly in light of my erroneous classification as an “other requester” rather than as a representative of the news media. I am in the process of appealing a similar determination by the NSA FOIA office in regarding request 70761.
