This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of the "vexsome filer list" which may also be known as a "serial filer list" or a "nuisance filer list." Include any other list of FOIA requesters used by your agency which lists FOIA requesters because of the quantity or type of FOIA requests they have submit or any other FOIA related behavior. Additionally, please include all records which mention when or how to add or remove a person from any of these lists or how being on such a list affects processing requests from listed requesters.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Mr. Smathers,

We still do not have a record of this request. You were advised via email (20 Feb 2013, below) to submit your FOIA request via fax, US postal mail or our online web submission at http://www.nsa.gov/public_info/foia/submit_foia_request/foia_release.shtml.

In accordance with the OPEN Government Act of 2007, the NSA established this email alias (FOIARSC@nsa.gov) to assist requesters with existing FOIA requests; not for submitting new requests. The FOIA regulations dictate that it is the requester's responsibility to submit a proper FOIA request in accordance with Agency regulations - those regulations regarding submitting initial FOIA requests were summarized in our 20 Feb 2013 email and can be found on the NSA FOIA website under Submit a FOIA (http://www.nsa.gov/public_info/foia/submit_foia_request/index.shtml)

After we notified you that we had not received the request and advised you of the proper ways to submit a request, since you did not submit your FOIA request via any of the three methods offered, we assumed you were no longer interested in pursuing the request.
