To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

Copies of contracts with Level 3 Communications and any final reports generated and delivered by Level 3 Communications to the agency over the past 10 years. If retrieving the contracts themselves is too burdensome please provide a list of contracts. Please include any processing notes made in completing this request.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Please amend my request with the following: I hereby request copies of contracts with Level 3 Communications, located at 1025 Eldorado Boulevard, Broomfield, Colorado 80021, and any final reports generated and delivered by Level 3 Communications to the agency over the past 10 years.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. I am a published independent reporter and a current contributor to Forbes (http://www.forbes.com/sites/runasandvik/). I have also had my journalism published on domestic and international blogs.

To the NSA Freedom of Information Act Appeal Authority,

This letter constitutes a formal appeal under the U.S. Freedom of Information and Privacy Acts (5 U.S.C. 552/552a) and the regulations promulgated thereunder.

Along with a letter dated May 14, 2014, the NSA responded to my request for copies of contracts with Level 3 Communications by saying no responsive records were found. You had assigned the request reference number #75453.

The NSA performed an inadequate search for records responsive to my request, which is violative of the FOIA. I hereby appeal the NSA inadequate search for records responsive to my request and request that the NSA conduct a new complete and thorough search for copies of contracts with Level 3 Communications, located at 1025 Eldorado Boulevard, Broomfield, Colorado 80021, and any final reports generated and delivered by Level 3 Communications to the agency over the past 10 years.
