This is in response to your November 08, 2013, Freedom of Information Act request for information on This is a request under the Freedom of Information Act. I hereby request the following records:

All emails, including attachments, to or from Mark Ybarra where the email was sent in November of 2013.

We are unable to process your request, because it is too broad. Please clarify and provide any additional information as to what type of records you are seeking (emails from who to Mr. Ybarra, to who from Mr. Ybarra, and all subjects you are inquiring about) and its affiliation with the United States Air Force. Additionally, identification of the record(s) desired is the responsibility of the member of the public who requests a record. The requester must provide a description of the desired record(s) that enables the Air Force to locate the record with a reasonable amount of effort. Without specific information, we are unable to direct your request to the appropriate office or agency. When responding, please reference our case number 2015-02108-F in your letter. We are holding your request in abeyance until we receive your clarification. Please reference FOIA Case 2015-02108-F in all correspondence. If we do not receive a reply by (10 work days), we will close this case file and you will need to initiate a new FOIA request for these documents. This is an appeal under the Freedom of Information Act. On 11/08/2013, I requested a copy of all emails to or from Mark Ybarra where the email was sent in November 2013. I was informed fourteen months later that the request was not specific enough. However, the request is clearly specific enough for a person familiar with the records to locate them, which is all the FOIA requests concerning the level of specificity. Please note that I requested current emails in November of 2013 for a current employee. If the person is no longer employed and the emails are now in an archived format, the difficulty in retrieving them is self inflicted as they were easily accessible when they were requested. Please process this FOIA request as it was initially written.

As stated on 13 Feb 15, your FOIA case is still being processed, not sure why you're not seeing emails I send back to you. The email stated that this case is still open and being processed. Mr. Ybarra no longer works here and the emails have been archived. This will take some time to retrieve them from the COMM Focal Point team. But this case is still open. I cannot give you an answer on why this case was not processed in 2013, I was not the FOIA manager, I have just recently took over in late 2014. Thank you

I submitted an appeal because the 1/16/15 email I received which stated: "We are unable to process your request, because it is too broad." Did you retract this statement in a later email? If so, I did not receive that email, please resend it. If you are retracting the 1/16/15 email and are processing my request as submitted, I am happy to withdraw my appeal.

I only mentioned the length of time the FOIA request was not processed because the 1/16/14 email indicated that my request is too difficult to process. Although I understand that has nothing to do with you personally, the agency should take responsibility for that and not ask me to make the request more narrow or deny the request as the 1/16/14 email indicated. When the records were requested, they were held by the FOIA office in a format very easy to retrieve. Any archiving of the records after the request was received should not be cause to deny the request now.

However, the response I received says
"This is response to your 8 November 2013 Freedom of Information Act request for all emails, including attachments to or from Mark Ybarra where the email was sent in November of 2013 regarding fee assessment for FOIA case 2014-00478-F"

Please note that I never asked for nor agreed to limit my request to emails that were "regarding fee assessment for FOIA case 2014-00478-F."

This limitation was not requested and therefore, you have denied my request, thus I appeal the denial of my request.

Please be aware that I do not con set to withdraw my appeal dated February 13, 2015. That appeal should be processed along with this one.
