Pursuant to the Indiana Access to Public Records Act, I hereby request the following records:

1. any requests for proposals, proposals submitted by vendors, contracts, budgets or cost allocations for the purchase and/or use of aerial drones, UAs, UAVs, and UASs (hereinafter “drones”);

2. any policies, guidelines, manuals and/or instructions on department use of drones, including on the legal process required (such as a warrant or court order), if any, before operating a drone;

3. any departmental records concerning this department’s use of drones now or plans to use drones in the future including:

a. the types of investigations or instances in which this department is using or plans to use drones, or how it plans to support, manage or oversee the usage of drones by another department or office;

b. policies, guidelines, manuals and/or instructions on storage requirements or procedures for video or static images obtained through use of drones, including retention times;

c. the altitude at which drones can or do fly;

d. drones’ ability to carry weapons.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

MuckRock is requesting documents related to NAVSEA's acquisition and use of unmanned aerial vehicles (UAVs), unmanned aerial systems (UASs), aka "drones."

Mr. Musgrave - Your September 28, 2012 Freedom of Information Act (FOIA) request concerning UAV/UAS documents has been partially transferred to this command from the Naval Sea Systems Command. Before we can begin to process your request, we will need a response concerning the following items:

1. In order to help to determine your status to assess fees, please advise which of the following categories you represent:

a. affiliated with a corporation or a state, local, or foreign government that is seeking information for a COMMERCIAL profit or trade use, or an individual seeking information for a personal use that furthers your commercial or business interest.
b. an individual, including an affiliate of a corporation or a state, local, or foreign government, seeking access to TECHNICAL DATA for any purpose, such as news gathering efforts, scholarly or scientific research, personal use, or a commercial profit or trade use.
c. an INDIVIDUAL seeking information for personal use or affiliated with a non-profit, public interest group seeking information in furtherance of the group's interest and not for a commercial profit or trade use.
d. affiliated with _____________________ an EDUCATIONAL or NONCOMMERCIAL SCIENTIFIC INSTITUTION, AND THIS REQUEST IS MADE FOR A SCHOLARLY OR SCIENTIFIC PURPOSE and NOT for commercial use.

2. Are you willing to accept CLEARLY RELEASABLE portions of responsive documents? Are definition of clearly releasable is attached.

3. Are you willing and able to pay fees associated with this request? Right now (until you advise what fee status you believe you fall within), our fees within the "Commercial Fee Category" are $44.00 per hour to search for responsive documents; and $44.00 per hour to review and redact the documents prior to being released; and $0.15 per page to copy released/responsive documents. If yes, please advise of the maximum fees authorized to process this request.

4. The FOIA is a record retrieval statute. NSWC Crane Division is not equipped to conduct a text search for terms such as "unmanned aerial vehicles, unmanned aerial systems, or drones." Do you have a specific CONTRACT NUMBER/REQUEST FOR PROPOSAL/INVOICE? If yes, please provide, otherwise I am unsure (at this point) as to how we might search for responsive records (i.e.: contracts, requests for proposals and invoices).

A response to the above questions is needed no later than Thursday, 21 June 2013 in order for this Command to keep this request active. If I do not receive a response to the above questions by that date, I will be required to close out this request with no action taken due to the fee issue and you will be required to resubmit your request at a later date.

Mr. Musgrave - based on the information you furnished below, placing this request into the "news media" category is not appropriate, as per instruction the news media refers to any person actively gathering news for an entity that is "organized" and "operated to publish or broadcast news to the public". This same instruction states that in order to be considered a "publisher" -- news must be disseminated and a product is available for purchase or subscription by the general public. In the case of "freelance" journalists, you must demonstrate a solid basis for expecting publication through an organization even though not actually employed by it. If you have a "publication contract" this would be the clearest proof to place you in this fee category.

Respectfully, you have quoted the FOIA statute very selectively when it comes to determining media status.

First, if you are to consider me a freelancer, the revised 2007 statute allows FOIA officers to consider past publication record of the requester in making a determination of media status. As I indicated in my previous email, my writing (on drones as well as other topics) has appeared in a number of traditional media outlets. These include The Boston Globe, The Phoenix magazine and The Progressive magazine. Additionally, I have written for online publication for several years, notably for DigBoston, Motherboard and the TODAY show website.

Additionally, MuckRock itself undoubtably qualifies as a media outlet under FOIA as revised in 2007. Specifically, FOIA provides that free distribution qualifies as a valid dissemination method for a media outlet, and not only purchase and subscription as you imply. Further, the statute explicitly provides that "as methods of news delivery evolve (for example, the adoption of the electronic dissemination of newspapers through telecommunications services), such alternative media shall be considered to be news-media entities."

MuckRock meets these requirements quite clearly through the articles posted on our site, which are free to access for the general public. By definition and through developing these articles, MuckRock "gathers information of potential interest to a segment of the public, uses its editorial skills to turn the raw materials into a distinct work, and distributes that work to an audience." Our articles have not only enjoyed significant traffic on our own site, but have been featured and cited by other media outlets at the local, national and international levels.

In light of the above, I request consideration as a media requester under FOIA, with all fees to be applied accordingly. As the information I request is of significant interest to the public, I also reassert my request for a waiver of all fees.
