Dear Mr. Delaware:

Thank you for submitting your Freedom of Information Act request for FBI
files to the National Archives and Records Administration, via the
*FOIAOnline* website. We received your request on July 30, 2018.

This office handles FOIA and Privacy Act requests for the National Archives
and Records Administration's *operational* records (records created by this
agency). Because your *FOIAOnline* request is for records that *may be
archival* (records created by or originated in a different agency but that
may have been transferred to the legal custody of NARA), we have forwarded
it to our *Office of Research Services, Special Access and FOIA* staff who
handle FOIA requests for archival records.

Since the *Office of Research Services, Special Access and FOIA* does not
process FOIA requests through *FOIAOnline*, your request has been removed
from the *FOIAOnline* website and you will be assigned a new tracking
number by that office within the next 20 business days. If you would like
to follow up with that office directly, please contact them at the address
below, or electronically via email.

From: National Archives and Records Administration

Mr. Delaware--

I am writing in response to your Freedom of Information Act request of July
30, 2018, for records in the custody of the National Archives and Records
Administration. Your request was received in this office on July 30, 2018,
and assigned FOIA case number *RD 57896*.

You requested access to case file numbers *100-HQ-405974 Serial 1;
100-HQ-405976 Serial 6; 100-HQ-408012 Serial 29 page 33; 61-HQ-10149 Serial
1067X page 46; 61-HQ-9105; 61-HN-17; 100-HQ-7060 Serial 1372 and 1344 Encl
page 11; 100-HQ-38459 Serial 70 page 3; 100-HQ-350697 Serial 35;
100-HQ-358197 Serial 1; 100-HQ-358738 Serial 23 page 4, Serial 29 pages
3-5, Serial 31 Pages 3-4, and Serial 37; 100-HQ-360696 Serial 6 Page 16;
100-HQ-3-110 Serial 64 pages 14 and 18, and Serial 282 page 2;
100-HQ-371571 Serial 18; 100-HN-5896; and 100-HN-6387 Serial 269 page 3*,
identified by the FBI as potentially responsive to your request for records
relating to *Ray Jerome Baker*.

Our office have also identified case file *100-WF-27588* as being
responsive to your request.

Please see the attached Excel worksheet for the results of my initial
assessment of all the above case files. Please note that Baker does not
always appear in the searched files. He is the direct subject of only four
of the files. I have tried to annotate how (or if) Baker appears in the
file, so that you may evaluate each file's usefulness to your research.

These files requires screening for categories of information exempted from
disclosure under the terms of the Freedom of Information Act, prior to
public release. In particular, there are documents that may be redacted to
protect the identities of confidential sources, including FBI informant
codes and informant file numbers.

Your request currently requires approximately 1395 pages of processing.
Requests for FBI case files that exceed 500 pages are assigned to our
second-tier processing queue. Files with more than 1,000 pages are
processed on an incremental basis. You will receive a response in partial
fulfillment of your request after we have completed the first installment.
We will provide you with an update on the status of your request and an
estimated completion date at that time. To give you an indication of our
existing backlog, we are currently processing second-tier requests received
in January 2013.

You may be able to reduce your estimated wait time by narrowing the scope
of your request to less than 500 pages and becoming eligible for our
first-tier processing queue. The estimated time required to complete the
processing of a first-tier request is approximately 24 months from the date
of this correspondence.

If you choose any combination of case files from the list that totals fewer
than 500 pages, your case would be eligible for first tier processing. If
you go this route,

*I would recommend you focus on 100-HN-5896, 100-WF-27588, 61-HN-17, and
61-HQ-9105*, as Baker is the direct subject of these files. Information
copied or summarized from other case files where Baker is mentioned would
be compiled into these investigative files where Baker is the named subject.

If you have specific questions regarding the subject of your request or *would
like to discuss narrowing your request*, please contact me directly at
Amanda.Weimer@nara.gov or at (301) 837-0604. All communications concerning
this request should reference your case tracking number RD 57896.

To notify this office of a *change in your contact information* or to *track
the status of your request*, please telephone 301-837-3190
<(301)%20837-3190> or e-mail specialaccess_foia@nara.gov.

opportunity to discuss our response, you may contact our FOIA Public
Liaison for assistance:

Dr. Weimar-

Hello! Thank you for the reply, and the spreadsheet. This message is in reference to FOIA case number: RD 57896.

I would like to narrow the scope of my request, in order to be eligible for first-tier processing.

As specified in your email, please focus on files 100-HN-5896, 100-WF-27588, 61-HN-17, and
61-HQ-9105. These are all files where Baker is a direct subject of the files.

From: National Archives and Records Administration

Mr. Delaware--

We can indeed narrow the focus of the request to 100-HN-5896, 100-WF-2588,
61-HN-17, and 61-HQ-9105, but the total page count for these four files is
approximately 875 pages. First tier processing is for cases with a total
of 500 pages or fewer. Would you like to narrow the request further, or
would you be okay with this case remaining second tier?

Mr. Delaware--

I shall make a note in the case file that you want to narrow the request to
100-HN-5896, 100-WF-2588, 61-HN-17, and 61-HQ-9105. Thank you for letting
us know.

If at any point you would like to check where you are in the second tier
processing queue, please contact specialaccess_foia@nara.gov for an update.
