This is a request under the Freedom of Information Act. I hereby request the following records:

All correspondence between the email address Beck.nancy@Epa.gov and email accounts including the domain name "@americanchemistry.com" since January 20, 2017. This is to include but not be limited to correspondence referencing the American Chemistry Council. We seek the initial correspondence as well as any response, follow-up, or attachment to the correspondence.

If it is your position that any portion of the requested records is exempt from disclosure, we request that you provide it with an index of those documents as required under Vaughn v. Rosen, 484 F.2d 820 (D.C. Cir. 1973), cert. denied, 415 U.S. 977 (1972).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Also, in order to complete this request as quickly and efficiently as possible, we request the EPA utilize its "e-discovery tools kit" to locate the relevant records. According to a statement made to the IT trade journal GCN by an EPA representative, the EPA's "email system is a cloud-based application, and our current suite of [e-discovery] tools does collect relevant data from email." https://gcn.com/Articles/2014/06/12/EPA-ediscovery.aspx?Page=2

We prefer the use of e-discovery tools to asking EPA Deputy Assistant Administrator Nancy Beck to conduct a search of her own email records, as that approach is likely to be time consuming and yield less accurate and comprehensive results.
As this request was filed over three months ago, we are also open to additional search methods used by the Office of Environmental Information, Office of Information Collection (OIC) that could speed completion of this request.

We haven't received a response to our request in a timely fashion. As you can see below, in March, we were told information needed to fill this FOIA had already been collected. As you know, an excessive delay in complying with a FOIA request constitutes a denial.
