I ask that all fees be waived as I am a journalist (examples of my work can be found at toddfeathers.com) and intend to use the requested records to publish articles in the public interest. In the event that you choose to impose fees, I request a detailed breakdown of the costs, including the hourly wages of any personnel assigned to process the request and estimates of how many hours the request will take them to process.

Should you choose to deny access to or redact records responsive to this request, I ask that you provide a detailed explanation of your reasoning--as required by law--citing the specific statutes and case law on which each decision is based.

Pursuant to the NSF FOIA regulations, you must state in your request a willingness to pay fees in order for us to begin processing your request. Please see language below from our regulations:

A request which otherwise meets the requirements of 45 C.F. R. § 612.3 is perfected when you have reasonably described the records sought under § 612.3(d), and agreed to pay fees under § 612.3(e), or otherwise met the fee waiver requirements under § 612.10.
You do have the option of pursuing a fee waiver under 45 C.F.R. § 612.10(k). The FOIA directs agencies to furnish records without any charge or at a reduced charge if disclosure of the information is in the public interest because it is likely to contribute significantly to public understanding of the operations or activities of the government and is not primarily in the commercial interest of the requester (5 U.S.C. § 552(a)(4)(A)(iii)).

Requests for fee waivers must be considered on a case-by-case basis and address the requirements for a fee waiver in sufficient detail for NSF to make an informed decision. In determining whether the statutory requirements are met, NSF must consider six factors in sequence. These factors are found in the attached document under section 612.10(k)(2) and (3).

Please address the six factors and clearly demonstrate that you meet the requirements, or provide us the amount you are willing to pay for this request. Most requestors agree to pay $25. At this time we do not consider your request perfected and no further action will take place. You have 5 days to respond or we will close the file on this request.
