This is a request under the Freedom of Information Act. I hereby request the following records:

All current interagency Memoranda of Understanding (MOU) or Memoranda of Agreement (MOA) between your agency and any other agency or department.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Good morning Mr. Smathers,

This is a courtesy reply - we are currently not authorized to work on Public FOIA Cases at this time. We are only allowed to work on ACTIVE DUTY requests, questions, and provide guidance on the FOIA and PA for our military members. Your case will be worked when we are authorized to work on Public requests.

However, as for your request for "All current interagency Memoranda of Understanding (MOU) or Memoranda of Agreement (MOA) between your agency and any other agency or department"; is too broad and too vague of what you are asking for. Each unit and/or command may have MOUs or MOAs, however, we do not have just one office that can gather or produce that type of information. There are hundreds of locations that could actually have multiple offices that could potentially have different agreements but as before there is not a single office that has that type of data you are seeking not to mention having the ability to determine just how many other agencies or departments that may or may not be in an agreement. Additionally, your request is "open-ended" which is not feasible to determine the time-frame you are actually looking for.

Also, you requested the fees to be waived. Since you represent the media you are entitled to 100 pages of duplication free of charge but are responsible for the payment of any fees beyond that - therefore, the request for a waiver is not granted.

You would have to provide a more specific and detailed request that could be reasonably searched and processed which is part of the requirement of being a proper FOIA request and at this time your request is not a proper FOIA request and cannot be processed as it stands right now.

If you wish to continue with this FOIA request please send a corrected FOIA request to smb.hqmc.foia@usmc.mil

Provide more of a specific and detailed request that can be reasonably searched and processed - prior to the Government Shutdown and the limitations that have been set on our office - your request was not proper. If a request is not proper and it continues to be vague - the case can be administratively closed.

Further, I request a list of all Memorandum of understanding (MOU) and Memoranda of Agreement (MOA) between your agency and any other agency or department. I am not asking you to create a listing, but rather, I understand that your agency maintains a listing.

Your request is still too vague - there are hundreds of offices and departments through the USMC which may have MOUs or MOAs with other agencies. Also, I do not understand what you mean by "your agency maintains a listing". I am not aware of one office within USMC that has a listing of all MOU and MOA for the entire USMC.

Your request is being controlled under case 2013F041068. As you know the Government was shut down for several weeks which place everything on hold and backed all cases up. I will process your request as soon as I can. However, reading your request it is too vague when you ask for "your agency" - which office or department in the USMC are you looking for? Also, we do not have CIA documents - you will need to contact them directly for CIA documents.

Until clarification is made on your request it is not a proper FOIA request.
