To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

All current interagency Memoranda of Understanding (MOU) or Memoranda of Agreement (MOA) between your agency and any other agency or department.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Jason Smathers

Mr. Smathers,

This acknowledges receipt of your Freedom of Information Act (FOIA) request to the U.S. Coast Guard (USCG), dated September 9, 2013. Your request was received in this office on September 12, 2013.

After careful review of your FOIA request, we determined that your request is too broad in scope or did not specifically identify the records which you are seeking. Records must be described in reasonably sufficient detail to enable government employees who are familiar with the subject area to locate records without placing an unreasonable burden upon the agency. For this reason, ยง5.3(b) of the DHS regulations, 6 C.F.R. Part 5, require that you describe the records you are seeking with as much information as possible to ensure that our search can locate them with a reasonable amount of effort. Whenever possible, a request should include specific information about each record sought, such as the date, title or name, author, recipients, and subject matter of the records, if known, or the USCG unit or office you believe created and/or controls the record. The FOIA does not require an agency to create new records, answer questions posed by requesters, or attempt to interpret a request that does not identify specific records.

Please resubmit your request containing a reasonable description of the records you are seeking. Upon receipt of a perfected request, you will be advised as to the status of your request.

If we do not hear from you within 30 days from the date of this email, we will assume you are no longer interested in this FOIA request, and the case will be administratively closed. Please be advised that this action is not a denial of your request and will not preclude you from filing other requests in the future.

You may contact this office at the telephone number provided below.

From: Jason Smathers

I am willing to revise my request to the following two searches:
1) "all interagency Memoranda of Understanding (MOU) or Memoranda of Agreement (MOA) between your agency and any of the following agencies:
The Department of Justice and other components in the Department of Justice
The Department of Homeland Security
The Central Intelligence Agency
The National Security Agency

You may limit the request further to MOA/MOUs currently in affect and further to those created on or after January 1, 2012."

2) "A list of all Memorandum of understanding (MOU) and Memoranda of Agreement (MOA) between your agency and any other agency or department. I am not asking you to create a listing, but rather, I understand that your agency maintains a listing."

Good afternoon Jason,

Since my earlier response to your inquiry regarding the status of subject FOIA, one of our attorneys was apparently concerned about the adequacy of the search for responsive documents. As a result, your file (request) was sent back to the program office for additional action. That action has been completed, and the file is once again awaiting review/signature, which should hopefully be completed this week.

Please let me know if you've any further questions or concerns.

Thanks

David
