Pursuant to the Freedom of Information Act, I hereby request the following records:
memos and incident reports related to Guantanamo detainee Abdul Latif Nasser (ISN 244): 000244 MFR 10-JAN-2008 / 000244 MFR 31-DEC-2007 / 000244 MFR 07-MAY-2007 / 000244 MFR 19- OCT-2007 / 000244 JDG INCIDENT 05-JAN-2008 23:22:00 / 000244 JDG INCIDENT 19-DEC-2007 16:58:00 / 000244 KB 05-JUN-2002.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
For fee categorization purposes, I am a representative of the news media. Through this request, I am gathering information for my journalistic work with New York Public Radio. a non-profit public radio news station. Accordingly, I am only required to pay for the direct cost of duplication after the first 100 pages. 5 U.S.C. § 552(a)(4)(A)(ii)(II); id. § 552(a)(4)(A)(iv)(II).
Please waive any applicable fees. Release of the information is not primarily in my commercial interest and will contribute significantly to public understanding of government operations and activities. 5 U.S.C. § 552(a)(4)(A)(iii). This information is in the public interest because it will shed light on the treatment of this particular Guantanamo detainee, as well as on our government's grounds for holding him which costs taxpayers millions of dollars per year.
Please provide expedited processing of this request which concerns a matter of urgency. As a public radio reporter / producer, I am primarily engaged in disseminating information. The public has an urgent need for information about the case of Guantanamo detainee Abdul Latif Nasser ISN 244 because he remains in detention despite being unanimously cleared for transfer two and a half years ago. The fact that the government has withheld Nasser for seemingly no reason - at a cost to taxpayers of approximately $11M/year (https://www.miamiherald.com/news/nationworld/world/americas/guantanamo/article2163210.html) - undermines any sense of due process, our standing among our allies, and yes, public confidence. As a major public radio outlet, we are doing a series dedicated entirely to his case which will considerably raise the profile of the story of this man who is being held back despite a promise of release, and without these files, will certainly add to public mistrust of the government. I certify that my statements concerning the need for expedited processing are true and correct to the best of my knowledge and belief.
