This is a request under the Freedom of Information Act. I hereby request the following records:

Records relating to Joseph Medicine Crow-High Bird AKA Joseph Medicine Crow (October 27, 1913 – April 3, 2016), who was the last living war chief of the Crow Tribe of Montana and a renowned Native American historian and anthropologist. Please conduct a search of the Central Records System, including but not limited to the Electronic Surveillance (ELSUR) Indices, the Microphone Surveillance (MISUR) Indices, the Physical Surveillance (FISUR) Indices, and the Technical Surveillance (TESUR) Indices, for both main-file records and cross-reference records.

FOIA case law establishes the extent to which agencies MUST search all records system reasonably believed to contain responsive documents, even if it means contacting former employees. Truitt v. Department of State, 897 F.2d 540, 542 (D.C. Cir. 1990) makes it explicitly clear that it is the obligation of the Department to “conduct a search reasonably calculated to uncover all relevant documents.” In addition, the Justice Department’s May 2004 FOIA Guide states that an agency “cannot limit its search to only one record system if there are others that are likely to turn up the information requested.”

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Created by the reauthorization of the USA PATRIOT Act in March 2006, the National Security Division (NSD) formally began operations on October 2, 2006. The NSD consolidated the national security components of the Department of Justice under a new Assistant Attorney General (the AAG for National Security). These components included the Office of Intelligence Policy and Review (now the Office of Intelligence) and the Criminal Division's Counterterrorism and Counterespionage Sections. The NSD also includes a new Law and Policy office responsible for providing legal assistance and for formulating legislative initiatives on matters related to national security law and policy. These organizational changes reinforce the Department's efforts to prevent terrorism and other threats to national security. In addition, the AAG for National Security acts as the Department's liaison with the Office of the Director of National Intelligence, the Central Intelligence Agency, the Department of Defense, and other intelligence community agencies in order to improve coordination against terrorism and other threats to national security.

I am responding on behalf of the Justice Management Division (JMD) of the Department of Justice to your Freedom of Information Act (FOIA) request dated May 2, 2016, asking for "Records relating to Joseph Medicine Crow-High Bird." None of the records systems you referenced are JMD systems. We performed a search of the JMD correspondence management system and found no responsive records. You have not provided any information indicating why you believe JMD would maintain records relating to the information you are seeking. JMD serves as the management arm of the Department. It provides assistance to senior management officials relating to organization, management and administration. JMD also provides administrative support services, such as personnel, accounting, payroll, procurement, budget, and facilities and property management to the Offices, Boards and Divisions of the Department. JMD does not investigate or litigate criminal or civil charges or actions against individuals, or enforcement matters. Given JMD's functions, we have no reason to believe JMD has records responsive to your request. Therefore, no further search has been performed. Unless you are able to provide more information about how the records might relate to JMD's functions, JMD will not be taking any further action on this request.
