To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

The correspondence between James McHenry and Gene Hamilton between January 20, 2017 and the date this request is processed. This is intended to include e-mail messages to, from, or copied to Gene Hamilton. It should include other forms of correspondence (for example: instant messages, Skype instant messages, text messages, letters, notes). We are not requesting search by keyword - we are requesting all of the e-mail messages, as the number should be relatively small.

I am a member of the news media and request news media status for this request. I am writing a story on interactions between the EOIR and the DHS in recent significant policy changes and plan to use the results of this request for my reporting.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Matthew Hoppock

Matthew,

There are potentially a large number of e-mails that both Director McHenry and Mr. Hamilton are listed on. Is there a particular policy or incident you are interested in? As written, your request is overbroad. We need to be able to perform a "reasonable search". We also need to be able to handle the results of the search.

Also keep in mind also that any responsive documents involving Mr. Hamilton must be referred to main justice for direct response to you. In this case, that would be all the documents. Have you considered making this request directly to OAG?

This morning I have filed a duplicate request with Main Justice. So, I am withdrawing the FOIA request previously submitted to EOIR.
