From: T. McElwee

To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

Records of an interception of a shipment of cocaine, described as follows:

"[A]pproximately May 2018, the [Drug Trafficking Organization] sent a shipment of approximately 250 kilograms of cocaine concealed in boxes of produce imports from the Dominican Republic to the Red Hook Port in Red Hook, Brooklyn, New York. CBP officers at the port identified and seized the cocaine."

Please note, the above is taken from a publicly-disclosed document prepared by the U.S. Attorney's Office for the Eastern District of New York. The case concerns a member of the NYPD (Amaury Abreu) accused of acting as a member of a drug trafficking organization in violation of his oath.

I assert that as the U.S. Attorney's Office has disclosed the seizure, the ongoing investigation exemption to FOIA ceases to apply. Further, the public interest in upholding integrity of law enforcement outweighs any interest in privacy.

Please provide all records of the interception and seizure, including any intelligence report regarding the shipment, any tracing of the shipment's origin, any record of the seizure operation and inventory of the shipment, any after-action reports, and any record of the disposition of the seized shipment.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

T. McElwee
