Pursuant to the Freedom of Information Act, I hereby request the following records:

Every e-mail messages sent from marknoferi@gmail.com to the DOJ and/or EOIR e-mail address(es) assigned to Mark Noferi, including mark.noferi@eoir.usdoj.gov and mark.noferi@usdoj.gov from January 1, 2017 to the date this request is processed.

To be clear, we are asking to have produced every e-mail message sent to any of the EOIR or DOJ e-mail addresses assigned to Mark Noferi is listed in the "to," "cc," or "bcc" fields and where the sender or "from" field is Mark Noferi's gmail address, marknoferi@gmail.com.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The agency has redacted much of the text of these e-mails that is not exempt. For example, the agency redacted the identity of e-mail message senders on every e-mail. Some of these messages appear to be Mark Noferi forwarding messages from an Immigration Professors' listserve (with which he's registered with his private e-mail) to his EOIR e-mail address. A number of others are just e-mail messages from third parties to Noferi's EOIR e-mail address. It's unclear why most of this information would be considered confidential. The listserve information was sent to a large listserve which does not treat its e-mail messages or membership as private. Individuals who join the listserve are warned in advance their messages aren't private. And the individuals e-mailing Noferi at his EOIR e-mail address surely have no expectation of privacy (given broad understanding that federal employees' e-mail messages are public records). There is no reason to have redacted these e-mail messages. The exemptions cited do not apply, and the agency should remove the redactions.
