All contracts (and their amendments), memorandums of understanding, intergovernmental service agreements, and any agreements of any sort entered into by Immigration and Customs Enforcement for all services, equipment, and activities involving/provided by/contracted for regarding the following detention facilities:

• Allen Parish Sheriff's Office
• Catahoula Correctional Center
• Evangeline Parish Sheriff
• Jackson Parish Correctional
• LaSalle Correctional Center
• Natchitoches Parish Correctional Pine Prairie
• River Correctional Center
• South LA ICE Processing Center
• Winn Correctional Center

Responsive materials should include but not be limited to:

• the initial Invitation to Bid, Request for Proposal, or equivalent call for contractors
• the responsive materials provided by the winning bidder
• all other vendor responses
• all evaluation material, scorecards, reports, and notes generated in the selection process
• the current contract
• all exhibits
• all amendments
• all invoices/receipts detailing compensation received as a result of any agreements
• all agreements related to the provision of services, such as water, sewage, natural gas, garbage, etc.
• all financial agreements (such as loans or bonds) entered into as a result or in association with any of the aforementioned agreements
• all agreements, invoices, and related materials regarding the use of inmate labor by any of this agency's divisions or jurisdictions

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Aftercareful review of your FOIA request, we determined that your request is toobroad in scope, did not specifically identify the records which you areseeking, or only posed questions to the agency.  Records must be describedin reasonably sufficient detail to enable government employees who are familiarwith the subject area to locate records without placing an unreasonable burdenupon the agency.  For this reason, §5.3(b) of the DHS regulations, 6C.F.R. Part 5, require that you describe the records you are seeking with asmuch information as possible to ensure that our search can locate them with areasonable amount of effort.  Whenever possible, a request should includespecific information about each record sought, such as the date, title or name,author, recipients, and subject matter of the records, if known, or the ICEprogram office you believe created and/or controls the record. I hereby appeal the adequacy of the agency's search, and the legality of the agency's withholding.

The statement of the subject matter requested must “reasonably describe” the requested information in as much detail as possible. 5 U.S.C. § 552(a)(3)(A)(i); see e.g. DHS regulations, 6 C.F.R. § 5.3(b). The detail of the request is “sufficient if it enabled a professional employee of the agency who was familiar with the subject area of the request to locate the record with a reasonable amount of effort.” Amending the Freedom of Information Act, H.R. Rep. No. 93-876 (1974). An agency must make “a good faith effort to conduct a search for the requested records, using methods which can be reasonably expected to produce the information requested,” Oglesby v. United States Dep't of Army, 920 F.2d 57, 68 (D.C.Cir.1990).

These criteria are more than adequate for a professional employee to locate the requested records. Such an employee could easily have performed a keyword search in ICE's Detention Management Division, Fiscal Management Division, and/or Domestic
Operations Division. The withholding of records is therefore unlawful.

Please process this appeal within the period allowed by law and remand to the agency for re-tasking and re-processing consistent with the Act.
