This is a request under the Freedom of Information Act. I hereby request the following records:
All communication with Lois Lerner and any representative of your agency including emails and other forms of communication. You can limit the records to those created between January 1, 2009 and January 1, 2012.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Good afternoon, Mr. Smathers:
Attached is the acknowledgment letter for your August 18, 2014 FOIA request.
Please note that the proper email address for submitting FOIA requests to the U.S. Office of Personnel Management (OPM) is foia@opm.gov<mailto:foia@opm.gov>. The OPM FOIA Requester Service Center had received three prior requests from you this year sent to the proper address. And then, for some reason, it appears you changed the email address.
If you send your FOIA submissions elsewhere in the agency, there is a chance that it will not reach us here at the FOIA Requester Service Center in a timely fashion. We had received communications from you up until April 2014.
Also, please alert others members of the MuckRock News group of the correct FOIA email address for us here at OPM.

Good Afternoon Mr. Smathers,
This is in reference to your request regarding "all communication with Lois Lerner and any representative of your agency including emails or other forms of communication". Although in your request you state that we "can limit the records to those created between January 1, 2009 and January 1, 2012", your request is still very broad. Please be advised that locating emails for that time period will require OPM's Network Management to retrieve at least 18 archived tapes of email records and the tapes can only be reviewed consecutively. Also, there is currently a long queue of several email requests ahead of yours. Based on their current workload, the earliest that Network Management will be able to start searching for records will be sometime in December. We estimate that the email search alone will take 6 months. Is it possible for you to narrow the parameters of your request to a particular office within OPM so, that we can get this to you in an quicker manner? Please advise.

Just following up as I have not heard from you regarding narrowing the scope of this request. Based on the estimated search time and review of any potentially responsive records, we are anticipating that the request will not be complete until midyear 2015. Please advise on whether you can narrow the scope of the request so, we can get this to you in a quicker fashion.

Trina and I checked with the program office responsible for conducting the email search. There are still two requests in the queue ahead of your request. Once they complete those requests, they can then begin searching for any potentially responsive emails for your request. Unfortunately, we do not have a tentative date of when they begin working on your request. We will keep you posted regarding the progress of the search.
