This is a request under the Freedom of Information Act. I hereby request the following records:

All communication with Lois Lerner and any representative of your agency including emails and other forms of communication. You can limit the records to those created between January 1, 2009 and January 1, 2012.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This is an appeal under the Freedom of Information Act. On June 17, 2014, I requested "All communication with Lois Lerner and any representative of your agency including emails and other forms of communication. You can limit the records to those created between January 1, 2009 and January 1, 2012."

Nearly a year later, in a letter dated June 2, 2015, you informed me that exemption (b)(6) applied to my request and it seems you have not even done any search for records.

As I am sure you are aware, Ms. Lerner was the head of the IRS and her emails to your agency would be done in her official capacity acting on behalf of the United States Government and exemption (b)(6) does not apply. The letter also mentions a (b)(7)(c) exemption, but I appeal this as well on the grounds that there was no review of the records and it is unlikely they they would contain (b)(7)(c) exempt materials.

Further, please note that you have exceeded that statutory time limit for fulfilling this request. Therefore, please consider the 2007 FOIA amendment restrictions on fees for requests where such a time limit is exceeded.
