On "2017-02-24T21:01:18Z" DHC ICE employee Recardo Perez (ricardo.perez@ice.dhs.gov) registered his government issued email
address with the "disappearing messaging" application service confide which may be in direct violation of public records laws sucj
as those spelled out in CRM 1663 titled "Protection Of Government Property -- Protection Of Public Records And Documents"
This FOIA request seeks an accounting of any DHS email addresses and phone numbers which have registered with the confide
service, and any inter or intra departmental legal discussion with regards to either this specific application or the use
of third party application which are not sanctioned by the department but which may hold public records that require
preservation.
minimally respondent records should include information regarding ricardo.perez@ice.dhs.gov (ricardo perez) AKA confide username "yc8pwmvx" and confide userID "807228" using public encryption key"0344238C8D04853CE8BE7F5AB54B4DCD861FEAEB28369B73F5EC1B54D9C2994972" for which records already publicly exist showing their use of the confide application utilizing government resources and potentially destroying public record.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

To Whom it may concern, my foia rejection appears to hinge on the belief that I am requesting items which may belong to the individuals involved, to the contrary, this request is for public records, created by public servants, using government provided resources (their government provided email address) which may have been used with a record destroying service such as "confide", and any documentation as to any policy which may cover the use of such servies with regards to the preservation of public records.
If you cannot provide these records, this request seeks an accounting of any respondent records so this issue can be further litigated in an appropriate forum.
