This is a request under the Freedom of Information Act. I hereby request the following records:

a. A copy of the Joint Universal Lessons Learned (JULLS) database;

b. A list of all After Action Reports entries in the JULLS database;

c. A list of all Remedial Actions Projects Program entries in the JULLS database.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This is in response to your Freedom of Information Act (FOIA) request for an electronic copy of the Joint Universal Lessons Learned (JULLS) database; a list of all After Action Reports (AARs) in JULLS; and a list of all Remedial Actions Projects Program (RAPP). We received this referral from the United States Northern Command (USNORTHCOM) on December 19, 2012.

By asking for the entire database you are essentially requesting every record in the JULLS system. The Joint Staff has advised this request would require manual review of over 1,000 records by 23 different organizations. The initial cost estimates exceed $300,000.

According to DoD 5400.7-R § C1.5.7.2. “About electronic data, the issue of whether records are actually created or merely extracted from an existing database is not always readily apparent. Consequently, when responding to FOIA requests for electronic data where creation of a record, programming, or particular format are questionable, Components should apply a standard of reasonableness. In other words, if the capability exists to respond to the request and the effort would be a business as usual approach, then the request should be processed. However, the request need not be processed where the capability to respond does not exist without a significant expenditure of resources, thus not being a normal business as usual approach. As used in this sense, a significant expenditure of resources in both time and manpower, that would cause a significant interference with the operation of the Component’ mission and would not be a business as usual approach.” Given the amount of resources required to fulfill your request, we do not believe that this request can be classified as “business as usual.”

If you are not satisfied with this action, you may appeal to the appellate authority, the Director of Administration and Management, Office of the Secretary of Defense, by writing directly to the Defense Freedom of Information Policy Office, Attn: Mr. James Hogan, 1155 Defense Pentagon, Washington, D.C. 20301-1155. Your appeal should be postmarked within 60 calendar days of the date of this letter, should cite to case number 13-F-0214, and should be clearly marked "Freedom of Information Act Appeal."

This is an appeal for denial of records in FOIA 13-F-0714. As documented in the attached, I narrowed this request considerably. As narrowed, my request for a listing of all entries in the JULLS database cannot be construed as unreasonably burdensome. Given that JULLS is a database, it is reasonable to assume that a summary of its contents can be exported or otherwise produced with minimal difficulty.

For this and any other reasons deemed applicable by the appeals authority, I appeal the rejection of this FOIA request.
