This is a request under the Freedom of Information Act. I hereby request the following records:
All documents, reports, files, and/or electronic-mail messages related to the Joint Special Operations Command's Task Force 17 ("TF-17") operations at the Baghdad International Airport ("BIAP"), Iraq, during Q2 2009; limited to the following constraints:
1. The inclusive dates of April 1, 2009, to June 30, 2009;
2. Excluding any records containing the agency’s deliberative material or recommendations;
3. Excluding any records classified Top Secret (“TS”), Sensitive Compartmented Information (“SCI”), and/or Special Access Program (“SAP”); however,
4. Including all of the agency’s responsive records classified below the TS, SCI and/or SAP levels; for example, any documents marked: Unclassified ("U"), Sensitive But Unclassified ("SBU"), For Official Use Only ("FOUO"), Confidential ("C"), Law Enforcement Sensitive ("LES"), and/or Secret ("S").
Although FOIA has always presumed that government records are open to public inspection, the FOIA Improvement Act of 2016, Pub. L. 114-185, prohibits agencies from withholding records unless (1) “disclosure is prohibited by law” or (2) “the agency reasonably foresees that disclosure would harm an interest protected by” one of FOIA’s exemptions. 5 U.S.C. § 552(a)(8)(A). Thus, in addition to FOIA favoring disclosure and requiring its exemptions to be narrowly construed, Section 552(a)(8)(A) prohibits agencies from using their discretion to broadly withhold records merely because they believe an exemption could technically apply.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

The actual processing time will depend upon its complexity, whether it involves sensitive records, voluminous records, extensive searches, consultation among DoD components or other agencies, and our administrative workload.
We have placed you in the "All Others" category for fee purposes, which means you are obligated to pay for all search time beyond two hours and duplication costs after the first 100 pages. We will attempt to provide the final response electronically or by CD as you requested, which would eliminate any reproduction fees.
The USSOCOM FOIA Office has a substantial number of pending FOIA cases, therefore, we process requests in a multi-track processing system based on the date of receipt and the amount of work and time involved in processing each request. We estimate the time for completion to be approximately 6-9 months; it could be more or less.
