Pursuant to the Freedom of Information Act, I hereby request the following records:

The Miami Immigration Court employs several "Judicial Law Clerks" who participate in an online "forum" for discussion of current immigration policy, including some discussion of specific cases. Understanding that certain case-specific discussions might be exempt, we are trying to obtain the discussions from the forum that are more generally policy-related. We have previously requested the messages from the forum itself and a screenshot of the forum, both of which have been rejected by EOIR (and both of which are now on appeal).

It is my understanding that when a message is posted to the JLC Forum, an e-mail is generated and e-mailed to the participants' e-mail box. The subject line begins with the phrase "JLC Forum" and then is followed by the message subject.

I am requesting the e-mail messages with the phrase "JLC Forum" in the subject line for the judicial law clerks who have worked at the Miami, Florida Immigration Court since January 1, 2017.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

The agency unlawfully withheld documents. The request was for a series of e-mail messages. The agency did not explain why messages could not be redacted to remove exempt information. Further, not all of the e-mail messages contain exempt information, as some of the JLC messages are about topics unrelated to attorney work product or predecisional information.

The agency also failed to conduct an adequate search.
