From: Nicholas Marritz
To Whom It May Concern:
Pursuant to the Freedom of Information Act, I hereby request the following records:
All records related to James Walter McCord Jr. (died June 15, 2017). Mr. McCord served as an FBI special agent and was one of the Watergate burglars.
Please conduct a search of the Central Records System, including but not limited to the Electronic Surveillance (ELSUR) Indices, the Microphone Surveillance (MISUR) Indices, the Physical Surveillance (FISUR) Indices, and the Technical Surveillance (TESUR) Indices, for both main-file records and cross-reference records for all relevant names, individuals, agencies and companies at FBI Headquarters. Please also conduct a search for records at the Alexandria Records Center. If any potentially responsive records have been destroyed and/or transferred to NARA, then I request copies of the destruction or transfer slips as well as any other documentation relating to, mentioning or describing said transfer or destruction, to include but not be limited to confirmation that the Bureau has no other copies of said records. If previously-released records are available, then I request a rolling release consisting of those records while additional records are located and processed for release.
REQUEST FOR FEE WAIVER
I request that all fees related to the processing of this request be waived. As one of the Watergate burglars, James McCord was a key player in a significant moment in American history. And because Mr. McCord was an FBI employee, the Bureau's records are likely to provide the public with significant insight into that moment. I am not making this request for commercial purposes— I am making it so that responsive records will be easily available to students, historians, journalists, and the general public. All responsive documents will be made available to the general public online for free. In the event that there are fees, I would be grateful if you would inform me of the total charges before fulfilling my request.
I would prefer that this request be filled electronically, by e-mail attachment if available or by CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Sincerely,
Nicholas Marritz

Re: FOIPA Request No.: 1437109-000
Dear FBI:
In response to my above-numbered FOIA request for records relating to James Walter McCord, Jr., I received the following response:
"In an effort to provide you with responsive records as expeditiously as possible, we are releasing documents from previous requests regarding your subject. We consider your request fulfilled. Since we relied on previous results, additional records potentially responsive to your subject may exist. If this release of previously processed material does
not satisfy your request, you may request an additional search for records."
I hereby request an additional search for records.
Thank you very much.
Most sincerely,
Nicholas Marritz

Dear FBI:
Yes, that's what I'm writing about. In a letter dated 24 May 2019, the Bureau stated that it was releasing 356 pages of records, but then added: "Since we relied on previous results, additional records potentially responsive to your subject may exist. If this release of previously processed material does not satisfy your request, you may request an additional search for records." I responded on 10 June 2019, stating: "I hereby request an additional search for records."
Please update me on the status of that search.
Sincerely,
Nicholas Marritz
