This email responds to your automated status checks regarding your FOIA request (Case 84015) for "a list of content pages for the unclassified Intelink wiki, Intellipedia-U."

As you may recall, we provided a Fee letter dated 22 April 2016 indicating that processing fees of $186.36 were due within 30 days of that letter. I note that your automated status check on 2 May 2016 , received via Fax, indicates a willingness to pay the fees. Another fax entry on 2 May 2016, indicates that you "enclosed a check for $186.36." However, since we did not receive payment, your request was closed in early June 2016.

If you believe the case was closed in error, AND can provide information that your payment was received and cashed by this Agency, I will be happy to research this further. Otherwise you may submit a new request via fax, mail or the online form.

"However, since we did not receive payment, your request was closed in early June 2016." That is utter nonsense. I immediately agreed to the fee. On 05/02/2016 I sent an email stating "I agree to pay the stipulated fees, up to $186.36, in association with FOIA case 84015A which requested "the list of content pages for the unclassified Intelink wiki, Intellipedia-U." Since then I have attempted to follow-up more than half a dozen times, only to be ignored by your agency each time.

All of the above can be confirmed on the MuckRock tracking page (https://www.muckrock.com/foi/united-states-of-america-10/intellipedia-u-content-list-24549/), and raw emails can be provided to further confirm the correspondence was sent. Re-open my request and place it in the proper spot in the processing queue, please - DO NOT put at the back of the queue because of your agency's failure to properly process the request in the first place.

I am appealing the closure of the request, as on 05/02/2016 I sent an email stating "I agree to pay the stipulated fees, up to $186.36, in association with FOIA case 84015A which requested "the list of content pages for the unclassified Intelink wiki, Intellipedia-U." " This can be confirmed at the MuckRock tracking page. As such, the Agency grossly failed to properly handle my request and repeated attempts to follow-up, violating both statute and caselaw in the process. The best excuse offered was that the NSA lost track of the email? That is, quite simply, laughable.

This letter is in regards to FOIA Case Number 84015A, which was specifically for:

"A list of content pages for the unclassified Intelink wiki, Intellipedia-U. This request was initially submitted on March 17, 2016 and was acknowledged by your office on March 22, 2016. By way of letter dated April 22, 2016, your office indicated that there would be fees associated with the processing of this request. This letter stated, in part:

"If you would like us to proceed with the processing of your request, please remit to the FOIA office (see below for address) a check or money order made payable to the Treasurer of the United States in the amount of $93.00 or provide a statement regarding your willingness to pay all assessable fees....If we do not hear from you within 30 days of the date of this letter, we will assume that you are no longer interested in pursuing this request, and we will administratively close your case with no further processing."

By way of a fax to 301-688-4762 sent on May 2, 2016, only 10 days later and far fewer than the required 30, Mr. Michael Best responded to your office, stating:

"I agree to pay the stipulated fees, up to $186.36, in association with FOIA case 84015A which requested "the list of content pages for the unclassified Intelink wiki, Intellipedia-U."

An automatic communication was then generated by our system on the same day, directly after Mr. Best submitted to us the full payment to be provided to your office. However, this amount was not sent to your office. This is because your letter posited two options: either provide a deposit of half the estimated amount OR agree to pay the full amount. His written agreement to provide the full amount should have sufficed to continue processing; the choice provided in your letter suggested as much, and it is our experience that it is easiest for all parties, but for the processing agency in particular, if the letter is followed exactly and payment submitted once full costs may be assessed, if that is the path chosen, the choice being between half payment now or full payment later.

In light of the preceding facts, it would be greatly appreciated if processing could continue on this request as the agreements between the parties would suggest is appropriate. A formal appeal, including your fee letter and the raw email containing Mr. Best's response, has also been submitted.

We received your 14 January 2017 correspondence, which expresses your concern that the FOIA Office closed your FOIA Case (#84015A) due to lack of payment for processing fees associated with your case. You had requested "a list of content pages for the unclassified Intelink wiki, Intellipedia-U." Your 2 May 2016 automated status check correspondence indicates your willingness to pay the $186.36, and that you enclosed a check. Since the latter correspondence indicated that a check was enclosed, the FOIA office could only interpret that to mean that a check was forthcoming via mail as our Agency does not accept electronic forms of payment. Please submit payment to the Department of the Treasury and mail to the National Security Agency, FOIA Office (P132), 9800 Savage Road, Suite 6932, Ft. George G. Meade, MD 20755-6932. As such, there is no further action required by the FOIA/PA Appeal Authority staff.

Your FOIA case has been reopened pending receipt of payment via mail within 30-days from the date of this correspondence. If the FOIA office does not receive payment within that timeframe, the case will be closed with no further action.

We sent a letter in June of this year to you to acknowledge receipt of your check. Note that the check is dated 31 May and we received it in early June, not February as you suggest.

To provide you an update, this case is in our review backlog and given the amount of material, once it is time to work it, we will only devote a few hours per week to it. While the information is unclassified, each entry must be checked to see if it is protected in any way (e.g. FOR OFFICIAL USE ONLY, SENSITIVE BUT UNCLASSIFIED). This is further complicated by the fact that the review will require consultations with numerous other government agencies, since a great deal of the information is not under the purview of NSA. Should you wish to narrow your request in any way, it is possible that could reduce the review time and get you a response sooner.
