From: Jason Smathers

To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

A printout of the index or directory listing showing the contents of the "My Documents" Folder (or any other location used as the primary location to store electronic documents, such as the Home folder on a Mac) on Dorthy Pullo's workstation and laptop computers (and any other computer assigned to this person).

I am not requesting all the files, I am requesting a listing of the files. Listings are available as a feature of the basic operating system and there are many simple ways to capture and print this data.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Jason Smathers

Hello,

As indicated below, there has been no communication from CBP regarding this request since an emailed acknowledgement in March 2012. A search of FOIAOnline also failed to uncover any tracking number or evidence of processing for Mr. Smathers' request.

Please advise.

From: TELL, STEPHANIE S.

Good afternoon,

I am responding on behalf of Sabrina Burroughs. Attached is the final response letter that was sent to you by the FOIA Appeals team.

We've have responded to all of your emails on behalf of Sabrina Burroughs. All expedited requests and appeals must be submitted through the FOIA Online website.

In addition, if you are a single or repeat FOIA requester, CBP strongly encourages you to click on the following link http://www.cbp.gov/site-policy-notices/foia to create a FOIAonline account before you submit a FOIA request. FOIAonline is very user-friendly – simply follow the prompts to create an account and make a FOIA request. Submitting your FOIA request online is the preferred method (vs. postal mail/fax) for several reasons:

• The requester immediately receives a unique FOIA tracking number and acknowledgment that his/her FOIA request was received,

• the requester is able to track his/her FOIA request any day/any time through his/her FOIAonline account,

• FOIA requests received online do not go through the DHS secure mail facility – which can take several weeks to be processed and reach the CBP FOIA office for action,

• the requester receives an email to retrieve responsive records via his/her FOIAonline account, when records become available.

• the requester can view all of his/her historical FOIA requests via the “dashboard” on the FOIAonline account.

If you have a pending FOIA request with CBP, and you do not plan to file a future FOIA request with CBP, you are also encouraged to set-up a FOIAonline account, so that when responsive records to your request become available, you can be notified electronically and view the records via your FOIAonline account. Please ensure when setting up your FOIAonline account that you use the exact same email address that you provided in the original FOIA request.

CBP receives a high volume of FOIA requests. We are taking necessary actions to address and reduce the backlog. We appreciate your continued patience.

Thank You -

Stephanie S. Tell, PHR, SWP, HCS
