This is a request under the Freedom of Information Act. I hereby request the following records:

I am requesting any and all documents that your agency retains regarding the 2017 Inauguration in Washington D.C. In particular, this request is for all records included but not limited intelligence reports, open source reports, electronic data, e-mails, photographs, intelligence data, notes or other materials.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

From: FOIA

Dear Ms. Hill:

After careful review of your FOIA request, we determined that your request is too broad in scope or did not specifically identify the records which you are seeking. Records must be described in reasonably sufficient detail to enable government employees who are familiar with the subject area to locate records without placing an unreasonable burden upon the agency. For this reason, ยง5.3(b) of the DHS regulations, 6 C.F.R. Part 5, require that you describe the records you are seeking with as much information as possible to ensure that our search can locate them with a reasonable amount of effort. Whenever possible, a request should include specific information about each record sought, such as the date, title or name, author, recipients, and subject matter of the records, if known, or the DHS component or office you believe created and/or controls the record. The FOIA does not require an agency to create new records, answer questions posed by requesters, or attempt to interpret a request that does not identify specific records.

Please resubmit your request containing a reasonable description of the records you are seeking. Upon receipt of a perfected request, you will be advised as to the status of your request.

If we do not hear from you within 30 days from the date of this email, we will assume you are no longer interested in this FOIA request, and the case will be administratively closed. Please be advised that this action is not a denial of your request and will not preclude you from filing other requests in the future.

Your request has been assigned unperfected reference number 2017-0527. Please refer to this identifier in any future correspondence.

Sincerely,

Hi TSA FOIA Branch

I would like to narrow my original request ( unperfected reference number 2017-0527) to copies of all Transportation Suspicious Incidents Reports (TSIR) created by the TSA Office of Intelligence that mention the 2017 Inauguration. In addition, I would like any e-mails created and/or received by the TSA Office of Intelligence and Analysis regarding the subject matter of the 2017 Inauguration.

Please let me know if you need any further clarification on this request.

Good morning,

Your request is in the queue to be processed. However, no records responsive to your request have been located/provided to the FOIA office as of yet. Please provide the following to help with the search for responsive records:

1) Timeframe for TSIR Reports

2) Time frame for emails

3) Search terms to be used to search emails

4) Optional, but helpful: individuals whose emails you want searched

Due to our case backlog and limited staff, processing of this case can take 6 months to a year or longer. The amount of pages needing to be reviewed will also impact the amount of time required to process. Also, It is likely that responsive records will have to be sent for additional review by our Sensitive Security Office for any sensitive security information (SSI). SSI review can add an additional 30 to 45 days of processing time. Please note that SSI cannot be released through FOIA as restrictions for disclosure are mandated by Federal Regulation 49 C.F.R. Part 1520<https://www.ecfr.gov/cgi-bin/retrieveECFR?gp=&SID=42646820a82e72d3e448b791348cc8fe&mc=true&n=pt49.9.1520&r=PART&ty=HTML>.

I look forward to your responses for above. The information you provide will be given to the program office to aid in their search.

Respectfully,

April Harrid

Hello again Melissa,

Currently no records have been provided to the FOIA office for your request. I sent a follow-up request to the program office and am waiting for a response on where they are in their search. Since we currently do not have any records, it is difficult for me to gauge when we will be able to provide a response. Depending on the amount of records and pages needed to be reviewed, and whether additional sensitive security information review is needed, I can only estimate 3 to 6 months based upon our current backlog as well as other requests in my queue that came in before yours.

I apologize for the delay. However, if you are unsatisfied with this response regarding our delay times, you have the right to seek dispute resolution services from the Office of Government Information Services (OGIS) which mediates disputes between FOIA requesters and Federal agencies as a non-exclusive alternative to litigation. If you are requesting access to your own records (which is considered a Privacy Act request), you should know that OGIS does not have the authority to handle requests made under the Privacy Act of 1974. You may contact OGIS as follows: Office of Government Information Services, National Archives and Records Administration, 8601 Adelphi Road-OGIS, College Park, Maryland 20740-6001; e-mail at ogis@nara.gov<mailto:ogis@nara.gov>; telephone at 202-741-5770; toll free at 1-877-684-6448; or facsimile at 202-741-5796.
