From: Paul Szoldra

To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

A copy of the following report: Audit of Medical Conditions of Residents in Privatized Military Housing (DODIG-2022-078).

I am preemptively waiving any objection to the redaction of the names of any U.S. Government officials below a GS-14 position or whom otherwise were not acting in a supervisory position. I similarly waive any objection to redactions of the names of any U.S. Government contractors in a position of authority similar to that of a GS-13 series civilian employee or below.
In terms of all other third parties who work or worked for the U.S. Government and whose names appear in records responsive to this request, I respectfully submit that the privacy interests of those individuals have been diminished by virtue of their involvement in one or more of the U.S. Government functions described above as falling within the scope of this request. There is a recognized inverse relationship between the position of authority that a government employee holds and the strength of that employee’s privacy interests. See Stern v. FBI, 737 F.2d 84, 92 (D.C. Cir. 1984); Jefferson v. Dep’t of Justice, 2003 U.S. Dist. LEXIS 26782, *11 (D.D.C. Nov. 14, 2003); see also Perlman v. Dep’t of Justice, 312 F.3d 100, 107-109 (2d. Cir. 2002)(setting forth five factors to consider in weighing government employee’s privacy interests against public interest in disclosure, including employee’s rank and whether information sheds light on a government activity).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Paul Szoldra, Task & Purpose

Dear Mr. Szoldra:

This responds to your Freedom of Information Act (FOIA) request for
DODIG-2022-078, Audit of Medical Conditions of Residents in Privatized
Military Housing. We received your request on April 6, 2022, and assigned
it case number DODOIG-2022-000712.

The Audit Component conducted a search and located the attached report
responsive to your request. Upon review, we determined that the report,
totaling 46 pages, is appropriate for release in part pursuant to FOIA (5
U.S.C. § 552) exemption (b)(6), which pertains to information, the release
of which would constitute a clearly unwarranted invasion of personal
privacy.

Our review included consideration of the foreseeable harm standard, as
stated in DoDM 5400.07. Under this standard, the content of a particular
record should be reviewed and a determination made as to whether the DoD
Component reasonably foresees that disclosing it, given its age, content,
and character, would harm an interest protected by an applicable exemption.

If you consider this an adverse determination, you may submit an appeal.
Your appeal, if any, must be postmarked within 90 days of the date of this
letter. Since you have created an account in FOIAonline, please log in to
your account, retrieve your original request, and then click on the “Create
Appeal” tab in the left-hand column. FOIAonline will populate your request
and contact information automatically. In the “Basis for Appeal” box,
provide your explanation, attach supporting documentation (if necessary),
click on preview, and then click on submit. Your appeal will automatically
be sent to our office via FOIAonline. However, please note that FOIA
appeals can only examine adverse determinations concerning the FOIA process.
For more information on appellate matters and administrative appeal
procedures, please refer to 32 C.F.R. Sec. 286.9(e) and 286.11(a).

You may contact our FOIA Public Liaison at FOIAPublicLiaison@dodig.mil, or
by calling 703-604-9785, for any further assistance with your request.
Additionally, you may contact the Office of Government Information Services
(OGIS) at the National Archives and Records Administration to inquire about
the FOIA mediation services they offer. The contact information for OGIS is
as follows: Office of Government Information Services, National Archives and
Records Administration, 8601 Adelphi Road-OGIS, College Park, MD 20740-6001,
email at ogis@nara.gov; telephone at 202-741-5770; toll free at
1-877-684-6448; or facsimile at 202-741-5769. However, OGIS does not have
the authority to mediate requests made under the Privacy Act of 1974
(request to access one’s own records).

If you have any questions regarding this matter, please contact Mr. Joseph
Kasper at 703-604-9775 or via email at foiarequests@dodig.mil.
