This is a request under the Freedom of Information Act. I hereby request the following records:

The annual report required under the Attorney General Guidelines for Offices of Inspectors General with statutory law enforcement authority for 2010, 2011, 2012 and 2013.

Per those guidelines (available here: http://www.ignet.gov/pande/standards/agleguidelines.pdf), these reports are due November 1 each year.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Hello,

I would like clarification regarding the attached response to FOIA request 2014-00210.

In the attached response letter dated November 7, 2004, Ms. Jeanne Miller cites a 2002 memo (available here: http://www.justice.gov/sites/default/files/ag/legacy/2009/02/10/ag-053002.pdf) in indicating that the Inspector General annual reporting requirement no longer applies. Having reviewed the cited 2002 memo, I see no such elimination of the annual reporting requirement for Inspectors General with statutory law enforcement authority.

The annual reporting requirement under which I've made the present FOIA request was established by a 2003 memo, which I've attached. (It is also available online here: https://www.ignet.gov/sites/default/files/files/invprg1211appf.pdf). Here is the relevant portion of that 2003 memo:

"XI. REPORTING REQUIREMENTS

Each Office of Inspector General shall make an annual written report to the Attorney General due on November 1 of each year, detailing the investigative and prosecutive activities of that Office of Inspector General. The report shall, at a minimum, contain information on the number of (1) federal criminal investigations initiated, (2) undercover operations undertaken, and (3) times any type of electronic surveillance was used. Additionally, the report shall provide information on all significant and credible allegations of abuse of authorities conferred by section 6(e)(I) of the
Inspector General Act by Office of Inspector General investigative agents and what, if any, actions were taken as a result. The names of the agents need not be included in such report."

Foremost, I note that the annual IG reporting requirement above was enacted by Attorney General Ashcroft in December 2003, whereas the memo cited by Ms. Miller was signed by Attorney General Ashcroft in May 2002. It is unclear to me how a May 2002 memo could have eliminated a reporting requirement enacted more than a year after that memo was signed. Secondly, the May 2002 memo concerns solely warrantless monitoring of communications, whereas the annual reports I've requested here are much broader: per the guidelines I've copied above, the requested reports are to include basic statistical information as to number of federal criminal investigations initiated, number of undercover operations undertaken, and number of times any type of electronic surveillance was used, as well as information on allegations of abuse of authorities.

Please advise as to whether the Department of Defense Office of the Inspector General has completed the annual reports as required by the December 2003 memo, or else provide more substantive justification for your failure to locate the requested reports.

As this request is quickly approaching a year since its original submission to your office, I must insist on clarification and release of responsive documents immediately.
