Pursuant to the Freedom of Information Act, I hereby request the following records:

1. All Organizational Charts for the ICE FOIA Office that were in effect during FY16-FY19.
2. Any document or electronic record showing the total full- and part-time staff (whether ICE employee or outside contractor) of the ICE FOIA office for FY16, FY17, FY18, and FY19.
3. A blank copy of any form or electronic record used by the ICE FOIA Office to task agency components with searches for and responses to FOIA Requests during FY16-FY19.
4. ICE's FOIA Office Policy and Procedure Manual.
5. Any contracts between the ICE FOIA Office and any contractor to perform duties or provide goods or services relating to FOIA requests.
6. All records of reflecting the total number of individuals employed or contracted by the ICE FOIA office as of the date the agency tasks an adequate search.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I hereby appeal this referral as to Items 1-2 and 5-6 because it fails to comply with DHS's independent obligation under the FOIA to search non-ICE custodians of record for responsive agency records. Please note that I have separately filed a FOIA to ICE for these requests. However, for this particular request, I specifically seek records outside of ICE and stored within DHS. This knowledge on the part of DHS, rather than solely on the part of ICE, as reflected in the anticipated responsive documents, is relevant to DHS's annual funding and budgeting requests to Congress, and to the agency's consistent representations regarding exceptional circumstances for processing times, the adequacy of agency budgeting for FOIA responses, and agency production schedules and capacity.

Please remand and retask the search to respond at the DHS level to 1-2 and 5-6.

I still have not received a response to this request. The agency's failure to timely respond constitutes a constructive denial rendering this matter ripe for litigation. If the agency intends to comply with the FOIA, it should do so no later than December 2, 2019.
