Pursuant to the Freedom of Information Act, I hereby request the following records:

Records relating to or mentioning HIDDEN INTERESTS (Major Case 38), the investigation into Bank of Credit and Commerce International (BCCI), including all sub files, bulky files and enclosures behind file (EBFs) if they exist. This investigation's existence is supported by the records released to me in FOIA request 1426573-000.

Please conduct a search of the Central Records System, including but not limited to the Electronic Surveillance (ELSUR) Indices, the Microphone Surveillance (MISUR) Indices, the Physical Surveillance (FISUR) Indices, and the Technical Surveillance (TESUR) Indices, for both main-file records and cross-reference records for all relevant names, individuals, agencies and companies. If any potentially responsive records have been destroyed and/or transferred to NARA, then I request copies of the destruction or transfer slips as well as any other documentation relating to, mentioning or describing said transfer or destruction, to include but not be limited to confirmation that the Bureau has no other copies of said records. If previously released records are available, then I request a rolling release consisting of those records while additional records are located and processed for release.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

To Whom It May Concern:

This is an appeal of FOIA request 1428903-000. I am appealing the integrity of the search performed in its entirety and the integrity of the b7a denial in its entirety. A blanket claim of potentially responsive records being part of an "investigative file" does not hold up to scrutiny considering there were records relating to the case in a request on Clark Clifford released to me (see 1426573-000) and previously, Joseph Lloyd (see 1391872-0; 1190819-0), meaning at minimum the activities of deceased individuals named in the case can be disclosed. This apparent failure to conduct any review for segregable material contradicts case law and the FOIA statute itself.
