I am writing in reference to your Freedom of Information Act (FOIA) request dated May 8, 2015 and received in the Defense Nuclear Facilities Safety Board (Board) FOIA Office on May 11, 2015 in which you requested "Any and all internal reports on the risks of geomagnetic storms to the nation." We appreciate your continued patience.

The provision of the Board's FOIA regulations governing the processing of your request states that in "unusual circumstances," the time limits prescribed for providing a response to your request may be extended by up to ten additional working days "by written notice to the requester." (See 10 CFR § 1703.108(b)). For purposes of section 1703.108, the term "unusual circumstance" includes, but is not limited to, the need for consultation, which shall be conducted with all practicable speed, with another agency. (See 10 CFR § 1703.108(c)(3)). The Board has located one potential responsive record which is undergoing classification review at the Department of Energy.

Please be advised I am invoking the provision to extend the time to process your request for an additional ten working days pursuant to section 1703.108(b). The original deadline for the Board's response is June 9, 2015. An additional ten working days will extend the response deadline to June 23, 2015. We expect to have a response at the latest by the end of the extension period on June 23, 2015. A response may come sooner.

This is the Defense Nuclear Facilities Safety Board's (Board) update to your Freedom of Information Act (FOIA) request (assigned tracking number 15-07) dated May 8, 2015, and received in the Board's FOIA Office on May 11, 2015. You requested "Any and all internal reports on the risks of geomagnetic storms to the nation." We appreciate your continued patience.

The Board invoked a 10 day extension for your request based on the need for consultation with another agency. (See 10 CFR § 1703.108(c)(3)). The additional ten working days extended the response deadline to June 23, 2015.

Please be advised that the document is still undergoing classification review at the Department of Energy (DOE). We have remained in touch with DOE regarding your request and are told that the document is currently under review. We'll let you know the results of that review as soon as we're notified. We are currently asking for status updates from DOE on a weekly basis.

For your information, this Office assigns incoming requests to one of three tracks: simple, complex, or expedited. Each request is then handled on a first-in, first-out basis in relation to other requests in the same track. Simple requests usually receive a response in approximately [one month], whereas complex requests necessarily take longer. At this time, your request has been assigned to the complex track.
