To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

All Council on Environmental Quality email records related to chemicals collectively identified by DuPont Company and The Chemours Company FC, LLC as GenX. The time frame for which we are seeking records is from January 2017 through April 2018.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

Working Narratives

Dear Working Narrative,

This is to acknowledge receipt of the Freedom of Information Act (FOIA) request[s] that you sent to the Council on Environmental Quality (CEQ). The assigned case number[s] and a summary of your request[s] is below:

1) FY2018-119 - emails related to GenX as described in your request below

I estimate the initial search fees to be $78 (1 hour x $78 per hour). This is for the initial search only, which may or may not result in responsive records. If responsive records are found, additional fees may be assessed to 1) complete the identification of responsive records, and 2) conduct the review of the responsive records. Please indicate whether you approve.

I am the FOIA Public Liaison and you may contact me with questions regarding your cases. You may also contact the Office of Government Information Services (OGIS) for assistance with FOIA. OGIS may be reached at:

Hi Howard, Because this request would contribute to the public understanding of the GenX water crisis impacting about 60,000 Americans in Wilmington, North Carolina we would request the council waive all fees. You can read about the crisis here: https://www.cbsnews.com/news/wilmington-nc-cape-fear-river-water-tainted-genx-dupont-chemours/. Additionally, in the event you choose to deny the waiver, the FOIA Reform Act of 1986 provides that nonprofit organizations pay for document-search time in excess of two hours. Please contact us before you incur labor costs or the use of information technology resources beyond that. Much thanks.

Dear Working Narratives,

You have requested special requester status for fee determinations. In order to verify your identity and evaluate this request, please provide a signed copy of this request on your organizational letterhead. For your convenience, you may simply email this to me in a PDF file. Please clearly state that the records you are requesting are not to be used for commercial purposes or for litigation purposes.

You have requested a fee waiver. Adjudication for the fee waiver will occur if/when fees become applicable. Since you have requested special requester status, fees are not applicable until I adjudicate your request for special requester status.

Very Respectfully,

Dear Working Narratives,

The status is pending your response to our email May 18, 2018. You have requested special requester status for fee determinations and I have asked for supporting documentation; please see below. As far as I can tell, this request is coming from muckrock.com not working narratives so I asked you to send me a signed letter on your organizational letterhead stating that the records you are requesting are not to be used for commercial purposes or for litigation purposes. Happy to discuss.
