Ms. Ram,
This concerns your Freedom of Information Act (FOIA) request for access to consumer complaints that relate to health and fitness and include, among other terms, "transgender," "gender dysphoria," and "gender affirming case." Your request was received in our FOIA office on June 12, 2018 and assigned control number FOIA-2018-01030.
As of the date we received your request, in accordance with the FOIA and agency policy, we have searched for and identified records that respond to your request. We are now in the process of reviewing those records, and we will produce them as soon as possible.
Please be advised that while the FOIA requires an agency to make a determination within 20 days of receiving a request, see 5 U.S.C. ยง 552(a)(6)(A)(i), it does not require actual production of the records within that time period. See CREW v. FEC, 711 F.3d 180, 188 (D.C. Cir. 2013). The actual processing time will depend upon on the complexity of the request, such as the need to search for, locate, and manually review distinct and separate records.
If you consider this response an adverse determination, you may seek dispute resolution services from the FTC FOIA Public Liaison Richard Gold via telephone at 202-326-3355 or via e-mail at rgold@ftc.gov<mailto:rgold@ftc.gov>; or from the Office of Government Information Services via e-mail at ogis@nara.gov<mailto:ogis@nara.gov>, via fax at 202-741-5769, or via mail at Office of Government Information Services (OGIS), National Archives and Records Administration, 8601 Adelphi Road, College Park, MD 20740.
In the interim, if you have any questions regarding your request, please contact me.
Sincerely,
Francis M. Conlon
