This is a request under the Freedom of Information Act. I hereby request the following records:

A copy of all data, statistics, and reports including performance data, studies, and other processing information related to Form G-28. The desired information is similar to that provided in the public state-wide receipts and approvals for all form types, except the request is for data and statistics related to Form G-28 which is Notice of Entry of Appearance as attorney. This request is filed in order to find data on how many cases, what types of cases, and where (by locality/region/field office/etc) G-28s are entered. If it is unclear what is requested, then a list of all reports and studies performed by USCIS and DHS regarding immigration cases - especially ones involving attorneys and BIA accredited representatives - is requested.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This is FOIA Request # COW2013000793, NOT # COW2013000745. Response APP2013001829 does not include a reference to this case (although the original appeal did consolidate them). You denied the appeal on # COW2013000745 because you believe the information on that case is not in the public interest. Are you now telling me that G-28 data is not in the public interest?

You have not addressed the elements of the appeal as related to this case. Therefore, administratively closing it is inappropriate.

In order to avoid delays while I pursue alternative remedies due to the appeal denial, I hereby state that I am willing to pay up to $50 in costs and request an estimate of any remaining fees that may need to be paid by category if fees are to exceed $50.
