This is a request under the Freedom of Information Act. I hereby request the following records:

A log of all FOIA requests made in fiscal year 2013.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

This was a non-commercial request for "A log of all FOIA requests made in fiscal year 2013." Because FOIA logs are routinely created and released, I find your denial of the request troubling. Nonetheless, I am responding to your questions so that you may either reopen this case or in the alternative open a new case for this information. To be clear, if you will not process my original request, this is a new request made under the Freedom of Information Act. I hereby request a log of all FOIA requests made in fiscal year 2013.

Here is a copy of my email from Saturday:

Ms. Kakel,

I received the sgt star input patterns in June of 2014 and consider that
request complete. I agree with the way we narrowed the request in #3, provided
that fees for any additional search time caused by narrowing the request is
waived as we discussed.

Mr. Smathers,

Per our conversation, we discussed the three FOIA requests you had sent to
U.S. Army Recruiting Command Ref: SGT Star and FOIA Logs.

1) Request for SGT Star Logs referred to Army Marketing and Research Group,
you were going to check you records to see if you received a response.

2) USAREC FOIA Log FY13, I expect to send you a response next week.

3) E-mails to or from MAJ between 1/1/14 and processing with the word
"star." Per our conversation you are willing to limit the search as the
catalyst for the request was the SGT Star request (category II information).
We discussed the large number of pages that contain the word star and that
portions of those records may be withheld as he is an attorney. You narrowed
the request to the MAJ's e-mail for SGT Star, Sergeant Star, SGT. Star, and
SGT-Star; if you can think of other iterations, please let me know. You
inquired about fees and I responded that this request will be processed in the
other category. You inquired about appeal rights, and I confirmed there is a
60-day timeframe from the date of response.

I appreciate your time and willingness to work with us.
