To Whom It May Concern:
This is a request under the Freedom of Information Act. I hereby request the following records:
A log of all FOIA requests made in fiscal year 2013.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Dear Mr. Smathers,
We have received your request for a copy of the NIH FOIA Log for FY 2013 as well as your request for the NCI FOIA Log for the same time period. I would like to talk with you about your request and I believe it would be more efficient to discuss my questions by phone rather than email. If you would call me at 301-496-5633 or provide a number where I can reach you, I would appreciate it.
Due to my recent schedule, I have been unable to contact you by phone. Will you please inform me via email any questions that may be delaying this FOIA request.
A copy of documents responsive to the request.
A cover letter granting the request and outlining any exempted materials, if any.
Our office sent a final response to your October 21, 2013 request on Friday, November 1, 2013. You should receive our response in the mail sometime this week.
This responds to your December 13, 2013 emails sent to the National Cancer Institute (NCI) and the National Institute on Drug Abuse (NIDA) asking for a status of your October 21, 2013, FOIA requests for the copies of the FY 2013 FOIA Log.
You may recall that you also submitted a request to the National Institutes of Health (NIH) that same day (Oct. 21, 2013) also asking for a copy of the FY 2013 FOIA Log. That request was assigned NIH FOIA 41786. We responded to that request on November 1, 2013 and provided a copy of the NIH FOIA Log. As we explained in our final response letter , the log provided to you on Nov. 1 included all requests received by NIH and its components during FY 2013, including NCI and NIDA.
In summary, your requests to NCI and NIDA were combined with your request to NIH and our response included the records for those components.
I hope this addresses your concerns.
