This is a request under the Freedom of Information Act. I hereby request the following records:

All records on Fred Phelps who was born on November 13, 1929 in Meridian, MS and died March 19, 2014 in Topeka, KS. Please include all records created between November 13, 1929 and March 19, 2014.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Fred Phelps engaged in odious protests and it is reasonable to believe that the US Attorney's office would have records created in determining if any crimes were committed or if prosecution is possible or desired. Further, earlier in Phelps' life he was a civil rights attorney and the US Attorney's office may have records related to this activity.

Phelps was a civil rights lawyer in Topeka, Kansas. He earned a law degree from Washburn University in 1964, and founded the Phelps Chartered law firm. As a result of a disciplinary complaint against Phelps filed by nine Federal judges, Phelps agreed to stop practicing law in Federal court permanently in 1989. Therefore, I expect records to exist in any district which included Topeka, Kansas between 1964 and 1989. Records will include both those related to his case work and his disbarment. Please search all locations that you believe may have records in light of this information.

The privacy exemptions do not apply because he is dead. His death is well known and was a major national news story. The Attorney General says that b5 should only be maintained if there would be foreseeable harm. The us attorney also failed to review the material for reasonable segregable portions. For these reasons and all other reasons deemed appropriate by the appeals agency, I appeal the withholding of the responsive documents.
