This is a request under the Freedom of Information Act. I hereby request the following records:

The most recent posts for fraud prevent managers regarding immigrant and nonimmigrant visa application processing at the U.S. Embassy in Sana'a, Yemen.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Requester seeks disclosure of any and all records that were prepared, received, transmitted, collected, and/or maintained by the U.S. Department of State (DOS), its Embassies, and its Consular Posts that describe, refer, or relate to immigrant and nonimmigrant visa fraud in Yemen and Sana'a, Yemen since July 18, 2008.

The requested records include, but are not limited to:
1. Each cable and/or other record with the subject of "Fraud Summary".
2. Each cable and/or other record tagged KFRD.
3. Each cable and/or other record regarding the Fraud Prevention Unit (FPU).
4. Each cable and/or other record regarding the Fraud Prevention Manager (FPM).
5. Each cable and/or other record regarding the Fraud Prevention Foreign Service National (FSN) investigator.
6. Each cable and/or other record regarding anti-fraud clerks.
7. Each cable and/or other record regarding PC-541 and related programs.
8. Any internal agency correspondence and/or documents pertaining to or discussing NIV/IV fraud.
9. All reports, including statistical reports, on NIV/IV fraud.
10. Any correspondence between DHS and/or USCIS, KCC (Kentucky Consular Center), the U.S. Embassy or Consulate, and/or DOS regarding NIV/IV fraud.
11. Each NIV/IV applicant and/or beneficiary's application and/or petition and/or all corresponding materials and/or reports written or issued that were found to be fraudulent.
12. Copy of all written decisions for each IV/NIV applicant and/or beneficiary where fraud was found or suspected (acceptances, denials, recommendations to revoke, administrative processing, and other decisions).
13. Any internal guidance, correspondence, and/or other documents discussing NIV/IV fraud prevention or providing guidelines for granting, denying, or revoking an application and/or petition.

In addition to the above requested records, the requester seeks the following information about each applicant, petitioner, and beneficiary:
1. Nationality or country of birth
2. Date of birth
3. Gender
4. Date of entry to U.S., if any
5. Length of stay in U.S., if any
6. Whether the applicant has legal counsel or a Form G-28 on file
7. Whether the applicant has U.S. citizen family members
8. Application/Petition status
a. If denied, recommended for revocation, or in administrative processing reasons/factors for decision
i. If denied, recommended for revocation, or in administrative processing for criminal history, national security, or public safety reasons, please specify what crimes, national security, or public safety reasons were the basis for the denial
b. If approved, reasons/factors for approval
c. If pending, reasons/factors for pending status or request for more evidence
d. If recommended for revocation, reasons/factors for recommendation
9. Time between filing application/petition and decision
10. Any comments about the application/petition or decision

Also, the requester seeks information about the total numbers of:
1. NIV/IV approvals that resulted in later fraud inquiries from DHS and/or CIS
2. NIV/IV approvals that resulted in removal proceedings and removal back to the country of origin

Requester asks that any records that exist in electronic form be provided in their native electronic format on a compact disc (CD), digital video disk (DVD), or equivalent electronic medium. Requester asks that any documents stored in Portable Document Format (“PDFs”) be provided as individual files in a searchable PDF format. Ideally, the information requested above would be provided in an Excel spreadsheet. Finally, requester requests copies of all NIV/IV application forms and cases that were reviewed internally after a denial or recommendation for revocation due to fraud factors and the outcome.

All requested records that are responsive may be provided with personally identifying details redacted.
