This is a request under the Freedom of Information Act. I hereby request the following records:
A copy of the contract referenced in the following notice sent out by the Department of Defense on 6/23/2015:
Messer Construction Co., Cincinnati, Ohio, was awarded a $24,166,000 firm-fixed-price contract with options for the addition and alteration of the Foreign Materials Exploitation Laboratory, Wright-Patterson Air Force Base, Ohio, with an estimated completion date of May 31, 2017. Bids were solicited via the Internet with three received. Fiscal 2012 military construction funds in the amount of $24,166,000 were obligated at the time of the award. Army Corps of Engineers, Louisville, Kentucky, is the contracting activity (W912QR-15-C-0012).
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Would your request be satisfied by receiving the Payment Bond, first two pages of the Contract, and letter from Chief of Contracting Division? This is called a Miller Act Package, and all of this is provided free of charge within three (3) business days. I am in receipt of your request for the Bonds Statute (formerly known as the Miller Act). In order to begin the claim process, please provide the following information, via email, as soon as possible:
Please forward an affidavit attesting to your supply of labor and/or materials to the Contractor, and its failure to pay you. The affidavit should include the name and address of your company as the provider of the work; the project name and work you provided; the public agency which is
USACE, Louisville District; the Prime's name, address, contract number and task order number (if applicable); and the amount claimed for work performed. This should be signed and dated by a Notary Public and sent to me as soon as possible in order to continue the process. Please include the name and email address of the claimant’s principal(s). Emailing the information to me is acceptable.
Pertinent surety and completion data, along with a signed letter from the Contracting Division's Chief, will be sent to you after we receive the affidavit, etc.

Hi Ms. Goodman,
I think we may have crossed wires here -- I submitted this request as part of an initial FOIA sent through the FOIA office. I was told a Miller Act package would be an efficient way to get a look at the documents I requested. I have no claim against anyone and am hoping this can be processed under FOIA. I really appreciate your help sorting this out.
