To Whom It May Concern:

This is a request under the Freedom of Information Act. I hereby request the following records:

All records concerning cases where a FOIA request is made by a fugitive to any federal agency and the information (such as address) provided with the FOIA requests is used by the US Marshals to make an arrest.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

The response to this request does not accurately address the request. The USMS response states:
"Please be advised that the USMS (Office of General Counsel) does not refer FOIA requests it receives for any purpose(s) other than FOIA only, and the office would have no way of knowing if the request is from a fugitive. The USMS has no policy on referring requests to agencies other than for FOIA purposes, in accordance with 28 C.F.R. 16.4. Thus, the USMS has no records responsive to your request."

The response states that USMS does not refer FOIA requests, however, I have asked for the opposite. My request is for records concerning cases where a FOIA request is made by a fugitive and the particular agency (other than USMS) in receipt of the request provides the information to the USMS for arrest of the fugitive.

Please conduct a search for the requested records.
