This is a request under the Freedom of Information Act. I hereby request the following records:

All records of Chief of Staff Brian McCormack, Deputy Assistant Secretary for Transmission Permitting & Technical Assistance Catherine (Katie) Jereza, Senior Advisor Alex Fitzsimmons, Director for State, Local, and Tribal Policy Analysis Katie Marks, pertaining to solar and net metering. Terms to use in the search of records can be limited to "solar", "net metering", "NEM". Please exclude press clips. The timeframe of this search is limited to July 1, 2017 through the processing date of the request.

The search for records should include emails along with attachments (both sent and received), agendas, notes, minutes, scheduling records, text messages (including other mobile-phone-based text communications e.g., Slack, Signal Messenger, WhatsApp) and material obtained in person at events and/or meetings.

Please note that this request includes all emails sent and received on official government email accounts, as well as any other email accounts that have been used for official business, which should include any software used by government employees to send emails (e.g. Entrust, Virtru). Emails and messages should include those addressed or "CC'd."

The requested documents will be made available to the general public, and this request is not being made for commercial purposes. It is in the public's interest to know DOE's role, as part of the Grid Modernization Initiative, in conducting a study of the cost and benefit considerations of net metering. Significant amount of press coverage has occurred regarding DOE's study, including articles from E&E News (https://www.eenews.net/stories/1060065697), UtilityDive (https://www.utilitydive.com/news/doe-seeks-stakeholder-input-data-for-net-metering-cost-benefit-study/505025/), and Forbes (https://www.forbes.com/sites/thebakersinstitute/2017/09/26/doe-and-net-metering-issues-to-consider/#146c1c03647b).

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not. However, I am requesting a fee waiver. The organization I work for, the Energy and Policy Institute, is a clearinghouse of information and can qualify as a representative of the news media. There are several examples of public record requests that have been provided to my organization and that were then published on our website to inform journalists publishing articles. Also, I have accounts with news outlets including Huffington Post and Republic Report. Past publications on these outlets as proof are available here (http://www.huffingtonpost.com/author/matt-kasper) and (https://www.republicreport.org/author/matthew/). Additionally, the Department of Energy has previously categorized FOIAs from the Energy and Policy Institute under Title 10, Code of Federal Regulations, Section 1004.9(b)(3) as a "news media" requester and have determined that I satisfy the criteria considered for a waiver of fees.

Would you be willing to amend your request for communications pertaining to solar and net metering to use the search terms:
"net metering" OR
"NEM" OR
"solar" and "metering"

I think the use of the word "solar" by itself could produce a large set of false hits since "solar" can be used in a variety of ways not related to metering.

Please reply with confirmation if you agree to this amendment. Or let me know if you want to discuss further, we can set up a time to discuss.
