Dear J Ader:

Thank you for submitting your Freedom of Information Act (FOIA) request to
the National Archives and Records Administration (NARA) via the FOIAonline
website. We received your request on March 21, 2022. Your request
concerns* FBI Files*.

Our office uses the FOIAonline portal for FOIA and Privacy Act requests for
NARA's operational records (records created by this agency). Since
your request
is for records that may be archival records (records created by or
originated in a different agency but that may have been transferred to the
legal custody of NARA), to which access is restricted, we are forwarding it
via this email to our Office of Research Services, Special Access and FOIA (RF)
staff who handle FOIA requests for such archival records.

Since Research Services does not process FOIA requests through FOIAonline,
we removed your request from the FOIAonline website. Special Access staff
will assign your request a new tracking number and respond directly to
you. In the future, if you need to follow up with that office directly,
please contact them at the address below, or electronically via email
(email is preferred).

Dear J. Ader:

I am writing in response to your Freedom of Information Act (FOIA) requests
received by this office on March 21, 2022 for records in the custody of the
National Archives and Records Administration (NARA). Your request has been
assigned FOIA Tracking Number *RD 67177*.

We are continuing to work on logging in FOIA requests in the order they are
received. Once your request reaches the front of the initial response
queue, a staff member will search for the record(s) and provide you with a
more substantive response detailing the results of the search and the
estimated completion date for your request.

Our small staff will continue to work diligently to process each request as
quickly as possible, but please be aware that we are operating at
significantly reduced staffing levels onsite and it is taking longer than
usual. We apologize for this inconvenience and appreciate your
understanding and patience.

We have also forwarded your request to our Textual Reference branch for a
search of potential DOJ files, and to the National Archives at St. Louis of
Mr. Frank's Official Personnel File for his employment with the Office of
War Information.

If you have any questions concerning this action, or to notify this office
of a change in your contact information, please email
specialaccess_foia@nara.gov or call 301-837-3190. All communications
concerning this request should reference your FOIA Tracking Number *RD

Dear Recipient,

Thank you for contacting the National Archives at St. Louis. The National
Archives and Records Administration has begun to phase reproduction and
digitization services back in. However, at this time we are only servicing
Burial, Medical Emergency, and Employment requests. Any other orders will
be placed in the queue and serviced in the order received. We apologize
for any inconvenience.

Due to the COVID-19 pandemic and pursuant to guidance received from the
Office of Management and Budget (OMB), NARA has adjusted its normal
operations to balance the need of completing its mission-critical work
while also adhering to the recommended social distancing for the safety of
our staff. As a result of this re-prioritization of activities, you may
experience a delay in receiving an initial acknowledgment as well as a
substantive response to your reference or FOIA request or appeal. We
apologize for this inconvenience and appreciate your understanding and
patience. *Case number **2-26418658642** has been assigned to your request.*

The National Archives will decide when to begin reopening our facilities
based on guidance from the federal government, including the Office of
Management and Budget (OMB), the Centers for Disease Control (CDC), and the
Office of Personnel Management (OPM). We are working diligently on our
plans for the gradual reopening of our facilities across the country. The
reopening plans will be based on local conditions for each geographic area
and OMB and OPM Memorandum M-20-23, Aligning Federal Agency Operations with
the National Guidelines for Opening up America Again. These plans will be
implemented in three gradual phases, which will likely last several weeks
or even months, based upon local conditions in the respective community.
Even as we begin to reopen, operations may be curtailed due to limited
staffing or the need to temporarily close facilities for cleaning. Please
understand the protection and safety of our staff, volunteers, and the
public remain our top priority. We will provide further information as it
is available - please monitor our web page https://www.archives.gov/st-louis

Dear J Ader:

I am writing in further response to your Freedom of Information Act request
RR2RR 22-29784 concerning access to a DOJ file on Harry Hart "Pat" Frank.
Our unit has been assigned to search the General Records of the Department
of Justice, Record Group 60 which is in our custody. The Special Access
and FOIA will respond with records in their holdings in a separate
correspondence. Your request was also sent to the National Personnel
Records Center for a search. Their office will respond separately to your
request, as well.

We searched the following for a reference to Harry Hart "Pat" Frank.: Criminal
Division: General Name Alphabetical Index, 1930-1984; Entry UD WW 3152;
General Records of the Department of Justice, Record Group 60
<https://catalog.archives.gov/id/23062753> and located a reference to
him in File
146-200-35841 which deals with investigations of Government employees
connected with subversive organizations. We were unable to locate the
corresponding file in our holdings. We suggest filing a FOIA request with
the Department of Justice in order to potentially gain access or obtain
more information on this file:
https://www.justice.gov/oip/make-foia-request-doj .

You may also be interested in viewing the: General Index to Litigation
Case Files, 1904-1951; Entry A1 110;
Record Group 60 <https://catalog.archives.gov/id/1882794>, . This series
is open and available for researchers to view in our research room and does
not require a FOIA request to access.

We do not consider this a denial of your FOIA request. However, if you are
not satisfied with our action on this request, your options for appeal and
dispute resolution are outlined in the attachment.

This concludes the processing of your request.

Sincerely,

RE: Veteran’s Name: FRANK, Harry Hart "Pat"
Request Number: 2-26418658642

Dear Recipient:

Thank you for contacting the National Archives at St. Louis.

We have located the Official Personnel Folder (OPF) for the above-named
federal employee. However, after examination of the record we have
determined that it is a non-archival (not open to the public) record.

OPFs for former Federal civilian employees separated after 1951 remain in
the legal custody of the Office of Personnel Management (OPM). Access to
such records is restricted under the Privacy Act of 1974 (P. L. 93-579) and
only limited types of information from these records are releasable to
non-authorized users under the Freedom of Information Act (FOIA).

Please refer your request to the National Personnel Records Center Civilian
Records Annex in Valmeyer, Illinois. They will contact you with further
information regarding your request when they reach your request in their
queue.
