This is a request under the Freedom of Information Act. I hereby request the following records:

FOIA Logs for Fiscal Years 2012 and 2013 (through date this request is processed).

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

I am responding on behalf of the Office of Intelligence and Analysis Freedom of Information Act Officer to your follow-up request for access to FOIA logs for FY 2012 and FY 2013. We were unable to locate your original request.

As I advised you in a separate email message pertaining to your request for the FY 2013 logs, this information is posted on the DHS website. I&A has not completed its FY 2013 log; the delay was occasioned by the government shutdown. You will find the I&A log for 2013 when it has been completed; in the meantime, the 2012 log is available at http://www.dhs.gov/publication/office-intelligence-and-analysis-fy-2012-foia-log.

If you construe this action on your request to be a denial of access, you may submit an administrative appeal to: Associate General Counsel (General Law), U.S. Department of Homeland Security, Washington, D.C. 20528, following the procedures outlined in the DHS regulations at 6 C.F.R. § 5.9.
