This is a request under the Freedom of Information Act. I hereby request the following records:

All records, including emails, in your agency's FOIA office discussing which fee category is appropriate for requests submitted by MuckRock or the FOIA Group, Inc.

This includes both: a) requests submitted by one of these businesses on its own behalf; and b) requests submitted by third parties in their own names using one of these businesses as an intermediary. This does not include records found in the administrative processing files for individual requests.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Since the denial of my request of my commercial status, the U.S. Coast Guard, acting as the designated appeal authority for DHS FOIA appeals, has reversed its position and begun granting appeals of determinations that MuckRock users are commercial requesters. The final determinations in Appeal Nos. 2014-HQAP-00032 and 2014-HQAP-00040 are two such examples. In light of this change in position, please reconsider the designation of my commercial category and reverse the determination that I am a commercial requester. Thank you.
