Thank you for your Freedom of Information Act request. The Environmental Protection Agency has received numerous Freedom of Information Act requests pertaining to Flint, Michigan drinking water. We are diligently processing these requests.
This letter concerns the above-referenced Freedom of Information Act (FOIA) request, received by the U.S. Environmental Protection Agency (EPA or Agency) on January 22, 2016, in which you requested:
“all communications between authorities in Flint, Michigan about the city's water contamination problem and the Environmental Protection Agency between January 1, 2015 and the date this request is processed.” Unusual Circumstances and Extension of Time
Pursuant to 40 C.F.R. § 2.104(d), an extension of time to respond to your request is necessary. Given the scope of the request, EPA anticipates that the response will require a significant amount of EPA’s resources and time to search for, and appropriately examine the voluminous amount of records to complete this request.
Since the time of your request and as of today’s date, EPA has received additional FOIA requests about Flint drinking water including several requests that were approved for expedited processing. These expedited requests will be processed before your request. However, many of the documents that are responsive to those requests will likely also be responsive to your request. These documents will be made publicly available on a rolling basis as they are produced. Opportunity to Discuss and Modify
Your request does not reasonably describe the records you are seeking in a way that will permit EPA employees to identify and locate them. Specifically, we would like to clarify which authorities in Flint, Michigan you are referring to.
EPA’s FOIA regulations state:
“Whenever possible, your request should include specific information about each record sought, such as the date, title or name, author, recipient, and subject matter. If known, you should include any file designations or descriptions for the records that you want. The more specific you are about the records or type of records that you want, the more likely EPA will be able to identify and locate records responsive to your request.” 40 C.F.R. § 2.102(c).
