To Whom It May Concern:
Pursuant to the Freedom of Information Act, I hereby request the following records:
The following records relating to Critical Energy/Electric Infrastructure Information (CEII) requests filed with the Federal Energy Regulatory Commission, pursuant to 18 C.F.R. 388.113(g)(5):
-copies of all non-disclosure agreements (NDAs) executed by persons or entities submitting CEII requests to the FERC between December 1, 2016 and the date this request is filed (should this part of my request require onerous search time or high reproduction costs, I request that an aggregated list of the persons and entities who have executed NDAs as part of the CEII request process be provided to me instead)
-copies of notices sent by the FERC to persons or entities regarding potential violations of the aforementioned non-disclosure agreements sent between December 1, 2016 and the date this request is processed
-copies of all CEII requests denied by the Federal Energy Regulatory Commission between December 1, 2016
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.
Sincerely,
Lucas Smolcic Larson

Please be advised that the Freedom of Information Act does not require the 'creation' of documents or lists. We kindly ask that you consider revising your request to seek a copy of the CEII logs. The logs will include the CEII reference number, name of requester and indicate the determination that was rendered for each request.
If you have any questions, please do not hesitate to contact the FOIA/CEII Service Center at foia-ceii@ferc.gov/(202) 502-6088 or contact me directly at (202) 502-8389.
Sincerely,

Toyia,
Thanks for the quick response. If the information I am asking for is presented on the CEII logs, then I would appreciate my request being revised to ask for these documents for the time period I have specified. I do ask that the 'Statements of Need' submitted to the FERC as part of the CEII request process be included with the logs.
Thank you,
Lucas Smolcic Larson

Please be advised that the CEII logs include the name of the requester, brief description of request, date received, date completed and indicate if material was released. However, the statement of need is not reflected in the CEII logs. We kindly ask if you would like to move forward with a request for the CEII logs.
If you have any questions, please do not hesitate to contact the FOIA/CEII Service Center at foia-ceii@ferc.gov/(202) 502-6088 or contact me directly at (202) 502-8389.

Toyia,
I would like to move forward with a request for the CEII logs. However, I am also requesting the statements of need submitted to the FERC. If you would like, I can file a separate request for those. Please let me know how to proceed.
Thanks,
Lucas

We kindly ask that you consider moving forward with your request for CEII logs. You will notice on the CEII logs that the vast majority of requests for CEII material are for FERC Form 715 data. These are annual reports that the electric utilities are required to submit to FERC that contain information regarding power flow for its transmission systems. Of course you can submit an additional request for 'statement of needs' if that is still of interest to you after your review of the logs.
For your convenience I am also providing a link to detailed information on our webpage regarding Form 715 data.
