RE: Affidavit requesting a Grand Jury investigation filed to the Court on or about December 10th 2015 by Affiant James D Benish and allegedly passed on to the sitting Grand Jury on or about January 18th, 2016. There is no known PACER or Federal Court Identifier

Subject: Communication between the Federal Judge and the Grand Jury. Communication between the Federal Judge and the Hawaii US Attorneys Office.

In consideration of the Federal Court District of Hawaii rules and procedures ie: ORDER REGARDING AMENDMENT OF LOCAL RULE 100 OF THE LOCAL RULES OF PRACTICE FOR THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF HAWAII 2013 Amendment and Amendments 2014—Pub. L. 113–187 it is requested that the court provide the following documents related to the Benish aforementioned Affidavit, hereby referred to as the “Benish Affidavit”. It should be noted that in reference to Grand Jury Proceedings’ the existence of a redacted Benish Affidavit has been made public and the veil of secrecy in reference to this particular document does not exist. I hereby request the following documents.
List of Documents
1. Please produce the Documents in your possession, custody or control which support the existence of the Benish Affidavit document in the courts possession by number or a item line number in the Courts record of received documents between the months of January 1st, 2016 and July 21st, 2017.
2. Please produce the Documents in your possession, custody or control which support the existence of the Benish Affidavit in the Courts internal records and if applicable, the PACER identifier relating to the Affidavit submitted by James Benish to the Court in December, 2015.
3. Please produce the Documents in your possession, custody or control which support the the number and type of Grand Jury the Benish Affidavit was submitted to between the months of January 1st, 2016 and July 21st, 2017.
4. Please produce the Documents in your possession, custody or control which support the courts possession of the Benish Affidavit.
5. Please produce the Documents in your possession, custody or control which support the Benish Affidavit transmittal of documents to a Specific Grand Jury and the type of Grand Jury, as in “Special Grand Jury.” between the months of January 1st, 2016 and July 21st, 2017.
6. Please produce the Documents in your possession, custody or control that represent correspondence with the Hawaii US Attorney’s office and or the US Justice Department referencing the receipt of the Benish Affidavit and Grand Jury participation in your possession between the months of January 1st, 2016 and July 21st, 2017.
7. Please produce the Documents in your possession, custody or control which support any and all correspondence between the Federal Court District of Hawaii Court Clerks and any and all individual Judges within the District of Hawaii Court. That refer to the Benish Affidavit between the months of January 1st, 2016 and July 21st, 2017.
8. Please produce the Documents in your possession, custody or control that represent correspondence including electronic correspondence referencing the Benish Affidavit with entities or persons who are not a part of or employed by the District of Hawaii Federal Court System and District court clerks between the months of January 1st, 2016 and July 21st, 2017.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
