FOIA REQUEST

This is a request for records under the provisions of the Freedom of Information Act. I request a copy of the contents of the administrative processing/tracking folder/file associated with the May 28, 2013 FOIA request from Kaitlin Devine at the Sunlight Foundation to GSA seeking an electronic copy of the FedBizOpps database. I also request a copy of any emails associated with the processing of the request. You may restrict this request to records dated from May 28, 2013 through November 10, 2013.

This is a noncommercial individual request that falls into the fee category “all other requesters”. I agree to pay up to $12 for statutory fees if necessary.

Please release all segregable releasable portions of otherwise exempt records. Please apply the presumption of openness.

Good afternoon Mr. Smathers,

We are currently processing our FOIA request for the "request a copy of the
contents of the administrative processing/tracking folder/file associated
with the May 28, 2013 FOIA request from Kaitlin Devine at the Sunlight
Foundation to GSA seeking an electronic copy of the FedBizOpps database."

In addition, you have requested "a copy of any emails associated with the
processing of the request. You may restrict this request to records dated
from May 28, 2013 through November 10, 2013."

In reference to the first part of your request, i.e. "electronic copy of
the FedBizOpps database we provided Ms. Devine, Sunlight Foundation", we
already have the information in electronic form and can have this to you in
the next couple of days at no cost to you. However, to acquire the
information in the 2nd part of your request (copy of any emails associated
with the processing of the request) will require a considerable amount of
time to search, retrieve, review and process.

If we can provide you with the electronic copy of the FedBizOpps database
(which we already have saved on three thumb drives), do you still require a
copy of any emails associated with the processing of the request?

Dear Mr. Smathers:

This letter is in response to your Freedom of Information Act (FOIA)
request (GSA number 261068), dated November 20, 2013, in which you
requested “a copy of the contents of the administrative processing/tracking
folder/file associated with the May 28, 2013 FOIA request from Kaitlin
Devine at the Sunlight Foundation to GSA seeking an electronic copy of the
FedBizOpps database. I also request a copy of any emails associated with
the processing of the request. You may restrict this request to records
dated from May 28, 2013 through November 10, 2013.”

Enclosed please find a portion of the documents responsive to your
request. The document enclosed is the workflow report generated by the
Intranet Quorum (IQ) system for the FOIA request from Kaitlin Devine at the
Sunlight Foundation (GSA number 252047). The report includes the following
information: requester’s name (primary person), date received (created),
due date, people associated with the request (people), GSA employees
associated with the request (agency contacts), internal GSA codes (workflow
codes), description of the request (comments), and the process of the FOIA
from start to finish (workflow). We have included a screen shot of our
system to provide clarity to the information enclosed. This is a partial
release of records and not a denial of records, we will continue to process
your request and will provide the documents associated with the IQ report
as well as the emails when they are ready.

In processing your request, we withheld entries that contained
attorney-client privileged information. This is done in accordance with the
fifth exemption of FOIA, 5 U.S.C. § 552(b)(5). Additionally, we withheld
personally identifying information to include a phone number extension in
accordance with the sixth exemption of FOIA, 5 U.S.C. § 552(b)(6). This is
done because public disclosure of this information would constitute a
clearly unwarranted invasion of personal privacy.

You have the right to appeal the denial of the information withheld. To do
so, you must write within 120 days of your receipt of this letter to:

Good Morning Mr. Smathers

Back on December 11, 2013, GSA sent to you a status update and
clarification email informing you that "we are currently processing
your FOIA request for the "administrative processing/tracking folder/file
associated with the May 28, 2013 FOIA request from Kaitlin Devine at the
Sunlight Foundation to GSA seeking an electronic copy of
the FedBizOpps database" and asking that "if we can provide you with the
electronic copy of the FedBizOpps database (which we already have saved on
three thumb drives), do you still require records of all email
communications to or from any individual within GSA?" Since that email, we
have not heard from you as to whether or not this arrangement was agreeable
to you.

Since that time, we have initiated a data pull to acquire all records to
include all email communications to or from any individual within your
organization in relation to Sunlight Foundation's FOIA request. The data
pull and our subsequent review of this voluminous data came back with
information unresponsive to your original request.

Before we initiate another data pull and review (which will be very
time-consuming do to our manpower limitations), we need to know if you
still require this information. Since you did not respond to the our
December 2013 clarification email request, the initial data pull did not
obtain anything relevant to your request and Sunlight Foundation already
received an electronic copy of the FedBizOpps database back in January 2014
without any issues, we would like to close this FOIA. If we are allowed to
close this FOIA, it would permit us to be more responsive to your other
outstanding FOIA requests we are currently processing.

Please let us know ASAP of your intentions. If we do not hear from you by
Thursday, 26 June 2014, we plan to close this FOIA.
