From:

Dear Mr. Richardson,

I am writing with regard to the Freedom of Information Act (FOIA) request
that the Federal Election Commission (FEC) received from you on June 12,
2015, FOIA 2015-61. In your FOIA request, you requested all ?Status of
Enforcement? reports circulated to the Commission from 2008 to the
present. Status of Enforcement reports are circulated on a quarterly
basis and the reports are cumulative, so reports circulated at the end of
each fiscal year include information for each quarter in that year.
Therefore, we are contacting you to see if providing the year-end reports
for 2008 through 2014 and the most recent quarterly report 2015 would
satisfy your request. Please let us know as soon as possible if you are
willing to narrow the scope of your request in this manner. If so, the
FOIA Office will be able to process your request on a more expedited basis

Sincerely,

Peter Han

I am following up on the Federal Election Commission?s (FEC) July 2, 2015

2015-61) you submitted to the FEC. In the FEC's July 2, 2015 email, you

2008 through 2014 and the most recent quarterly report 2015 would satisfy
your request. Please let us know within 20 business days if you are
willing to narrow the scope of your request in this manner. If so, the

Re: Freedom of Information Act (FOIA) Request No. 2015-61

Dear Mr. Richardson,

This responds to your request for information from the Federal Election
Commission (FEC) under the Freedom of Information Act (FOIA), dated June
11, 2015, and received by the FEC?s FOIA Requester Service Center on June
12, 2015. You requested:

All ?Status of Enforcement? reports circulated to the Commission for the
period 2008 to the present.

On July 2, 2015, the FEC?s FOIA Requester Service Center emailed you to
obtain clarification regarding the scope of your request. After not
receiving a response, FEC?s FOIA Requester Service Center emailed you on
July 10, 2015 to follow-up regarding the request for clarification. On
July 16, 2015, you responded to the FEC?s FOIA Requester Service Center?s
email and agreed to narrow the scope of your request. Specifically, you
agreed that the year-end Status of Enforcement Reports for Fiscal Years
2008 through 2014 and the quarterly reports for the first two quarters of
Fiscal Year 2015 would satisfy your request.

We have searched our records and located responsive documents, which we
are releasing in part. See attached (FOIA 2015-61_001-266). From the
responsive documents we have redacted certain information pursuant to FOIA
Exemptions 3(A) and 5. FOIA Exemption 3(A) prevents disclosure of
?specifically exempted from disclosure by statute (other than section 552b
of this title), if that statute?(A)(i) requires that the matters be
withheld from the public in such a manner as to leave no discretion on the
issue; or (ii) establishes particular criteria for withholding or refers
to particular types of matters to be withheld.? 5 U.S.C. § 552(b)(3)(A).
The Federal Election Campaign Act (FECA) prohibits the FEC from disclosing
information about pending Enforcement matters, as well as information
concerning conciliation negotiations. 52 U.S.C. § 30109(a)(4)(B),
(a)(12)(A) (formerly 2 U.S.C. § 437g(a)(4)(B), (a)(12)(A)). Exemption 5
protects from disclosure inter- or intra-agency memoranda or letters which
would not be available by law to a party other than an agency in
litigation with the agency, including documents covered by the attorney
work-product, deliberative process, and attorney-client privileges. 5
U.S.C. § 552(b)(5).

You may appeal any adverse FOIA determination. Any such appeal must be
filed in writing and should follow the guidelines set forth in 11 C.F.R. §
4.8. If you have any questions, please contact the FOIA Requester Service
Center at FOIA@fec.gov, or (202) 694-1650. Thank you for contacting the
FEC.

Sincerely,

Peter K. Han
